  • HOMEEXCHANGE.COM INC., a company incorporated under Californian law, with an office at C/O WEWORK, 625 Massachusetts Ave, Cambridge, MA 02139, for the Americas (United States, Canada, Latin American countries), United Kingdom, Australia, New Zealand, and Asia;
  • HOMEEXCHANGE SAS, a company incorporated under French law, registered with the Paris Trade and Companies Register under number 990 435 604, with its registered office at 45 rue de Chabrol, 75010 Paris, in the European Union, the rest of Europe (except United Kingdom), and Africa.
The purpose of the Platform, as defined below, is to connect members of the HomeExchange community so that they can exchange their homes.
By using the Platform, creating an Account, and/or purchasing any membership on our Platform you represent that you have read, understood, and agree to bound by and comply with these Terms of Service (the “Terms”), as applicable to you.

Your Contracting Party

  • If you are resident in Europe (except United Kingdom) or Africa, your contracting party is HomeExchange SAS. The HOMEEXCHANGE SAS Terms of Service below apply to you.
  • If you are a resident of the Americas (United States, Canada, Latin American countries), United Kingdom, Australia, New Zealand, and Asia, then your contracting party is HomeExchange.com Inc. The HOMEEXCHANGE INC Terms of Service below apply to you.
Notwithstanding the above, if you are a UK Consumer (as defined below), the following marked “UK-specific” provisions shall apply to you and prevail where they provide greater protection.
Please note that your use of the HomeExchange Platform is also governed by other documents and policies incorporated by reference into these Terms. For avoidance of doubt, the following are integral parts of these Terms:

If you do not agree to the Terms, as applicable to you, do not access the Platform.

Terms of Use and Services of HomeExchange SAS

Applicable to Registrants and Members in Europe and Africa
Included in these Terms of Use and Services are:
We may periodically update our Terms. These changes will apply to you if you continue to use the Platform at any time after the publication of these changes. If you do not accept the updated Terms, you will not be allowed to access or use the Platform. We will notify you of any modifications to these Terms via email.
We provide various links within these Terms to useful resources, including our FAQ, which answers the most frequently asked questions by our Members and Registrants.

I. Definition of Terms

  • "Membership" refers to the subscription by the Member to the HomeExchange Service for a period of twelve months in exchange for the payment of the price.
  • "Listing" refers to any Property described on the Platform by a Member or Registrant, including any User Content used to describe the Listing. Each Listing has a unique identification number on the Platform.
  • "App" refers to any HomeExchange application for mobile phones, tablets, and other connected devices.
  • "Deposit" refers to the security deposit, as described in more detail in Section IV "HomeExchange Services," point 4 "Management of Deposits."
  • "Code of Conduct" refers to the set of rules of conduct and the behavior expected from members of the HomeExchange community before, during, and after an exchange.
  • "Account" refers to the account that must be created to allow an individual to become a Member and access the Services offered by the Platform.
  • "User Content" refers to the information provided by the Hosting Member in their Listing.
  • "Exchange" refers to a home exchange concluded between a Hosting Member and a Guest Member. Exchanges can be:
    • (i) simultaneous with another home exchange concluded by the same Guest Member and Hosting Member, where the Guest Member also lends their Property to the Hosting Member,
    • (ii) a non-simultaneous reciprocal exchange concluded between the two Members, or
    • (iii) an exchange for GuestPoints, independent of any other home exchange (Unilateral Exchange).
  • "GuestPoints" (also referred to as "GP" on the Platform) refers to the points accumulated by Members, the functioning of which is described in more detail in Section IV "HomeExchange Services," point 1.2 "GuestPoints."
  • "Registrant" refers to any individual who registers on the Platform and thereby accepts these Terms.
  • "Hosting Member" refers to a Member who offers their Property for exchange.
  • "Guest Member" refers to a Member who concludes an Exchange with a Hosting Member.
  • "Member" refers to the Registrant who subscribes to the HomeExchange Service and benefits from unlimited access to Exchanges during the 12 months of the Membership’s validity, within the limit of the available GuestPoints of the Member.
  • "Collection Member" refers to a Member who has subscribed to the HomeExchange Collection service on an annual basis and benefits from unlimited access to Exchanges during the 12-month Membership period.
  • "Verified" refers to a Registrant whose Property address, identity (name and surname), email, and phone number have been confirmed by HomeExchange through its automated verification service.
  • "Property" refers to any permanent residential real estate (excluding, among others, RVs, boats, mobile homes, and other non-permanent structures) that a Member has the legal and/or contractual right to offer via the Platform.
  • "Collection Property" refers to a unique property carefully selected by HomeExchange based on a list of predefined criteria as described in Section IV, point 7. These services are provided as electronic services via the Internet and are automated.
  • "HomeExchange Service" refers to the Services provided by HomeExchange to Members as described in Section IV.
  • "We", "Our", "Us", and "HomeExchange" refer to HomeExchange or any company within our group.
  • "Platform" refers to the website www.homeexchange.com and any HomeExchange Application for mobile phones, tablets, and other connected devices.
  • "I", "You", "Your" refers to you (the Member or Registrant using the Platform in any way, by accessing the websites, the App, or the services).

II. General Use of the Platform

Your use of the Platform is conditioned upon your compliance with these Terms, including our Code of Conduct, which you must strictly follow and which reflects the core values of our community.
By using the Platform, you agree to:
  • Not provide false or misleading information when registering your Account or to any Member, Guest Member, or to HomeExchange, and not to create multiple or false accounts.
  • Not post on the Platform, or transmit to others, any defamatory, inaccurate, abusive, obscene, coarse, offensive, sexually oriented, threatening, harassing, racist, discriminatory or illegal material, or any material that infringes or violates the rights of another party (including, but not limited to, intellectual property rights and privacy and publicity rights).
  • Not upload or transmit files containing viruses, corrupted files, Trojans, malware, or any other software or programs that may harm the operation of another person’s computer or gain unauthorized access to that computer.
  • Not accept payment from a third party in exchange for conducting a commercial activity on the Platform in violation of these Terms without the express permission of HomeExchange.
  • Not assign or transfer your Account to another person or entity.
  • Not interfere with another Member's or Registrant's Account, circumvent measures intended to prevent or restrict access to the Platform, or use indexing robots or other bots, or "scrapers," to collect content from the Platform, Members, or Registrants.
  • Not collect, obtain, or use in any way information about other people, including email addresses, without their consent.
  • Not offer a Property for rent to Members or Registrants.
  • Not exchange a Property with a Member or Registrant outside of the Platform.
You also agree that:
  • You take full responsibility for the use you make of any information on the Platform.
  • You have the power and right to enter into this Agreement, post your Listing, and offer your Property for Exchange, including having the owner’s authorization if you are a tenant.
  • You are solely responsible for your communications and relationships with other Members or Registrants.
  • If you believe in good faith that a Member or Registrant is violating these Terms or has acted inappropriately or illegally, you must immediately report this Member or Registrant to us (see Section IX User Content Moderation) and, if applicable, to the relevant administrative or judicial authorities.

III. Membership Rules

Account Creation

To register on the Platform, you must first create an Account by providing the requested personal information, including your name, surname, date of birth, phone number, and email address. You may only create one Account for your household and for the people with whom you share your primary residence. If multiple people live in or own the same Property, that Property can only be offered for Exchange under one Account. You may choose to treat other adult members residing in the Property as authorized users of your Account, as long as they live with you.
Members and Registrants must keep their Account information up to date at all times. HomeExchange cannot be held responsible for any erroneous or fraudulent information provided by Members or Registrants. During registration, you must:
(i) be at least 18 years old at the time of registering your Account;
(ii) have the legal or contractual right to offer the Property for Exchange through the Platform and continue to have this right during your use of the Platform;
(iii) have the power to conclude an Exchange. Furthermore, a Member Account is for the exclusive and personal use of that Member, and no Account may be created for professional or commercial purposes.
HomeExchange may refuse to create an Account for a Member or Registrant in case of non-compliance with these Terms, risk of fraud, inaccurate information, or foreseeable violation of Platform rules. This refusal may occur at any time before the final validation of the Account, without compensation.
When registering, Members or Registrants provide an authentication email and a password, which can only be modified upon request from the Member or Registrant. Each Member or Registrant is solely responsible for their authentication email and password and agrees to keep them confidential and not to disclose them to anyone, in any form, for any reason.
Each Member or Registrant is solely responsible for any use of their username or password by a third party, as well as for any action or statement made by a third party through their Account, whether fraudulent or not, and releases HomeExchange from any responsibility regarding any related claim. Additionally, HomeExchange disclaims any liability in case of identity theft of a Member or Registrant. If a Member or Registrant has reason to believe that a third party is fraudulently using their identity or otherwise using their Account in an unauthorized manner, they must immediately inform HomeExchange. In case of loss or theft of a username or password, the Member or Registrant must immediately change their username and/or password and will be solely responsible for any damage related to such loss or theft.
It is prohibited to list a Property through multiple Accounts: You agree to create and/or use only one Account per household or for the people with whom you share your primary residence. Any exception to this rule must be approved in writing by HomeExchange.
All Members or Registrants act exclusively for their own account and benefit. HomeExchange does not control or direct Members or Registrants in any way, and each Member or Registrant acknowledges and agrees that they publish a Listing or participate in an Exchange freely and at their own discretion.
If you register your Account using a third-party social network service (Google, Microsoft, Facebook, etc.), you can deactivate the connection between your social network account and HomeExchange by accessing your Account settings.

Account Verification

Upon creating an Account, a Registrant or Member must provide proof of address and identification. The verification of these documents is carried out using an automated system, which notably relies on recognition and comparison processes. This automated processing has the sole purpose of confirming the authenticity of the submitted document and its correspondence with the information provided by the Registrant or Member.
The documents provided and the data extracted from them are only accessible to individuals authorized by HomeExchange when necessary, especially for control, auditing, or technical issue resolution purposes. The processing is conducted under appropriate technical and organizational security measures to ensure its confidentiality and integrity.
Identification documents and associated data are retained for the duration of the use of our HomeExchange Services in compliance with applicable regulations, particularly regarding personal data protection (see Privacy Policy).
HomeExchange also verifies the phone number and email address of the Registrant or Member through an automated system. Any verified email address or phone number will be marked as such in the profile of the relevant Registrant or Member.
Once the identity proof, address proof, phone number, and email address of a Registrant or Member are verified, they are considered "Verified" on their profile.
In case of failure of the automated verification process or suspicion of fraud, HomeExchange reserves the right to request further verification, suspend, or delete the Account of the Registrant or Member.
Only Verified Members will be able to finalize Exchanges on the Platform.
The mere fact that the proof documents, email address, and phone number of a Member or Registrant have been verified by our automated service does not guarantee the accuracy or authenticity of the information or any Listing provided by the Member or Registrant. HomeExchange cannot be held liable for the information provided by Verified Members or Registrants or their Listings.

Listings

Hosting Members must keep their Listings up to date and accurate at all times, including:
  • Any User Content included in the Listing;
  • The description, location, and availability dates;
  • The necessary and essential information about the Property and its expected use by the Guest Member, its features, and included amenities (e.g., pools, lighting, HVAC systems, security devices, etc.);
  • If applicable, the legal obligations to be respected at the location of the Property (e.g., database registration requirements for the Exchange location, application of tourist taxes, etc.).
A Property can only appear under one Account, even if multiple individuals have rights over the Property. Listings cannot contain hyperlinks.
HomeExchange reserves the right to request that certain minimum information be included in the Listing and that the Listing information be presented in a particular format.
The placement of Listings in Member or Registrant search results may vary and depend on various factors, including:
(i) user profiles (age, Member or Registrant quality, available GuestPoints),
(ii) Listing details (Property description, availability, GuestPoints value),
(iii) activity of the Member or Registrant on the Platform (logins, response rate, calendar updates), and
(iv) preferences identified by the Member or Registrant (favorites). HomeExchange provides no guarantee regarding the specific placement of a Member or Registrant’s Listing in search results.
All Members and Registrants declare and guarantee that publishing a Listing and accepting an Exchange for a Hosting Member's Property will not violate any agreements or regulations that may apply to the Property due to its membership in a homeowners' association, cooperative agreements, or other similar agreements.
They further agree that their Properties and Listings comply with all applicable laws, including zoning laws, tax requirements, and any other rules or regulations applicable to the Property or Listing.
Hosting Members are responsible for their own actions or omissions when creating their Listings.

Account Closure

4.1. Accounts Closed by HomeExchange
If a Member or Registrant:
(i) acts in violation of these Terms or any other rules issued by HomeExchange,
(ii) behaves contrary to our Code of Conduct, or
(iii) violates any law, rule, regulation, or other legal order issued by a competent jurisdiction, HomeExchange reserves the right to:
  • Limit access to the Platform for this Member or Registrant;
  • Suspend access to the Platform for this Member or Registrant;
  • Delete any User Content hosted on the Platform;
  • Close an Account;
  • Cancel upcoming Exchanges;
  • Report the incident to the relevant authorities.
HomeExchange may close the Member or Registrant’s Account without prior notice or warning (without prejudice to the claim rights provided below) in case of a serious breach of these Terms, the Code of Conduct, or the law. Closing an Account does not waive HomeExchange's right to claim damages that it could otherwise seek in connection with this violation.
The closure of the Account results in the immediate termination of the Member’s current Membership, with no right to any reimbursement, even partial, of the Membership fee. All GuestPoints accumulated by this Member will be canceled and permanently lost.
In the event of Account closure by HomeExchange, the Member or Registrant will receive an email notifying the reasons for such a decision.
If the Account closure is based on the dissemination of illegal Content or a breach of these Terms, the Member or Registrant may file a complaint according to the procedure outlined in Section IX User Content Moderation.
If the closure of the Account is based on any other reason, the Member or Registrant may file a complaint according to the procedure outlined in Section XIII Dispute Resolution.
HomeExchange reserves the right to disconnect, terminate, delete, or empty your Account, all associated Listings, and all related information from the Platform and our servers after a period of inactivity of 3 years, in accordance with our Privacy Policy.
4.2. Account Closure at the Request of a Member or Registrant
Members or Registrants of the Platform can, at any time and for any reason, terminate their registration on the Platform by requesting the closure of their Account with HomeExchange. To cancel an Account, a Member or Registrant must fill out the form available here.
Any request for Account closure by a Member after the expiration of the 14-day cancellation period will not result in any refund, even partial, of the amounts paid for that Account.
This request will take effect one business day after HomeExchange receives the request for Account closure, and all future Exchanges will be canceled. However, if an Exchange is in progress at the time of the request, the Account will not be closed until the Exchange and all related activities are completed. HomeExchange will confirm the closure by sending an email to the former Member at their email address.
When an Account is closed, all GuestPoints accumulated by the Member will be canceled and permanently lost.

IV. HomeExchange Services

Members must be up to date with the payment of their Membership in order to perform an Exchange and benefit from the HomeExchange Service.
The HomeExchange Service includes the following services:
  • Access to the Platform for performing Exchanges (see point 1 below),
  • Email service (2.),
  • Automated verification service before concluding an Exchange (3.),
  • Management of Deposits (4.),
  • 24/7 personalized emergency assistance (5.),
  • Free HomeExchange Guarantee in case of damage, theft, or other losses incurred by the Hosting Member (6.).
All the Services included in the HomeExchange Service and offered by it are indivisible and cannot be subscribed to individually.
Additionally, specific services and benefits are reserved for Collection Members (7.).

Access to the Platform

1.1. General Description of the Main Access Service to the Platform
HomeExchange provides its Members with an electronic service to access the Platform for performing Exchanges, allowing the Hosting Member to publish a Listing to offer an Exchange of their Property, and enabling the Guest Member to view the Listing and book the Property offered for Exchange by a Hosting Member. HomeExchange is simply a matchmaking Platform. When Members conclude an Exchange, they form a contract directly between them. HomeExchange is not a party to any Exchange and is neither a real estate broker, insurer, nor agent. HomeExchange does not receive any compensation for the Exchange made between Members.
Each Exchange constitutes a limited authorization granted by a Hosting Member to a Guest Member to enter, occupy, and use the Property during the agreed period. As permitted by applicable law, Hosting Members reserve the right to re-enter the Property strictly within the conditions of the Exchange agreed upon by the Members. If a Guest Member does not vacate the Property at the end of the agreed Exchange period, the Hosting Member may take all legal measures authorized to force the Guest Member to vacate the premises. The Guest Member agrees to pay, for each additional 24-hour period during which they do not vacate the Property, all compensation claimed by the Hosting Member in relation to the failure to vacate. Guest Members authorize HomeExchange to pay such compensation from the Deposit (security deposit) they have paid, noting that this authorization to release the Deposit to the Hosting Member does not waive the Hosting Member's right to claim full compensation from the Guest Member.
Members wishing to perform an Exchange via the Platform do so at their own initiative and responsibility.
Members must have an active Membership in order to finalize and execute Exchanges. If a Member has agreed to an Exchange with another Member that is set to take place after their Membership expires, they must renew their Membership to complete the Exchange. If the Membership is not renewed within 48 hours following HomeExchange’s email reminder, the Exchange will be canceled, and the Members involved in that Exchange will not be entitled to the protection mechanisms set out in points 1.3 and 1.4.
HomeExchange does not guarantee the legality of any Exchange concluded between Members nor its proper execution by any Member. Furthermore, HomeExchange does not provide any guarantee regarding the availability of the Property, the conditions of the Property, or any other condition imposed by one Member on another during an Exchange.
Members bear sole responsibility for the risks associated with offering or occupying a Property in connection with an Exchange, including the risk of property damage or theft of furnishings.
Hosting Members are free to choose the Guest Member who will use their Property. Hosting Members and Guest Members should engage in preliminary correspondence to address (and avoid) any issues that may arise from an Exchange.
Hosting Members must provide and communicate all necessary and useful information about the Property, including devices, features, and amenities included (e.g., pools, lighting, HVAC systems). They must communicate the house rules that they expect the Guest Member to follow.
Hosting Members will be responsible for carrying out any formalities or notifications that may be necessary with the relevant authorities.
Guest Members are solely responsible for the actions or omissions of each of their guests (whether disclosed to the Hosting Member or not) present in the Property. These guests must comply with all requirements or rules set by the Hosting Member and must be informed of and abide by these Terms.
Guest Members declare and guarantee that they are legally authorized to act on behalf of any minor included in the Exchange. No minor may participate in an Exchange unless accompanied by an adult who is legally responsible for them.
1.2. GuestPoints
Exchanges are carried out using GuestPoints previously acquired.
The Registrant receives GuestPoints as a welcome gift after creating an Account and completing their Listing. These welcome GuestPoints are time-limited and must be used within 3 months following the publication of the Listing by the Registrant.
Members then acquire GuestPoints by exchanging their Property or by referring new Members.
The number of GuestPoints obtained per Exchange varies depending on HomeExchange's assessment of the Property based on factors such as the number and type of bedding, comfort, and location. The methods for calculating the Property’s value are described in more detail in the article "What is the value of my house in GuestPoints?" available on our website.
A Member or Registrant can make limited adjustments to the GuestPoints evaluation proposed by HomeExchange, as described in the article "Can I modify the GuestPoints value of my house?" available on our website.
A Member can earn GuestPoints if they conclude a reciprocal Exchange: (i) with another Member whose Property has a lower GuestPoints value than their own Property, or (ii) with another Member staying in their Property for a longer period than their own stay. Reciprocal Exchange Members may, by agreement, modify the number of GuestPoints earned/used for that Exchange, provided that the GuestPoints per night do not exceed the GuestPoints suggested by the website.
For non-reciprocal Exchanges, only the Hosting Member receives GuestPoints. If a Guest Member does not have enough GuestPoints to conclude an Exchange for a given Property, the Guest Member can purchase the missing GuestPoints via credit card through the Platform.
GuestPoints are non-transferable, cannot be exchanged for money or other goods, and have no intrinsic monetary value. GuestPoints are non-transferable, non-divisible, and cannot be combined with the Accounts of other Members or Registrants. Furthermore, GuestPoints are not transferable to heirs, for example, by inheritance, bankruptcy, or divorce. Any attempt to circumvent these rules by any means is prohibited. More information about GuestPoints is provided in the article "About GuestPoints" available on our website.
GuestPoints cannot be used after the expiration of the Membership. Only a renewal of your Membership will allow you to use the accumulated GuestPoints to perform new exchanges. Therefore, when your Membership expires, the accumulated GuestPoints will remain linked to your Account as long as your Account remains active and not closed. They can be used again once you have renewed your Membership.
The management of credits, debits, and other GuestPoints is automated and does not involve HomeExchange intervention.
1.3. Protection of the Hosting Member in case of Cancellation by the Guest Member
If a Guest Member cancels an Exchange, the Hosting Member has the option to either return or not return the corresponding GuestPoints to the Guest Member.
If a Guest Member cancels due to an emergency situation and provides the appropriate documentation, HomeExchange may return the GuestPoints to the Guest Member (while allowing the Hosting Member to retain the corresponding GuestPoints).
1.4. Protection of the Guest Member in case of Cancellation by the Hosting Member
If a Hosting Member cancels an Exchange, the HomeExchange teams will make their best efforts to offer the Guest Member the possibility to stay in one or more replacement Properties.
The basic features of a replacement Property are as follows:
For any offer:
  • Sleeping capacity corresponding to the number of guests;
  • Hot and cold water supply;
  • Electrical supply;
  • Refrigerator;
  • Bathroom; and
  • Cooking unit (oven, stove, or microwave).
When expressly indicated that the element would be provided:
  • Swimming pool;
  • Internet connection;
  • Access for disabled persons.
Location:
  • The replacement Property must be located within 50 km of the original Property;
  • The replacement Property must be located within 5 km of a coastal beach if the original Property was located within 5 km of a coastal beach.
If HomeExchange is unable to find one or more replacement Properties with basic features equivalent to those of the canceled Exchange and if the Guest Member's Membership remains active for the entire duration of the canceled Exchange, the applicable GuestPoints will be refunded by the Hosting Member to the Guest Member, and HomeExchange will reimburse the Guest Member upon presentation of the appropriate documents:
  • Either the relocation costs for a period equivalent to the planned Exchange, upon presentation of relocation invoices for the same dates as the canceled Exchange, up to €110/night (or €275/night for HomeExchange Collection services) and up to 15 nights, with a maximum reimbursement of €1,650 per canceled Exchange (or €4,125 per Exchange for HomeExchange Collection services);
  • Or travel costs for a canceled trip upon presentation of invoices and cancellation and non-refund documentation, up to €110/night (or €275/night for HomeExchange Collection services), and up to 15 nights, with a maximum reimbursement of €1,650 per canceled Exchange (or €4,125 per Exchange for HomeExchange Collection services);
For example, if the canceled Exchange (excluding HomeExchange Collection services) was for four nights, the Guest Member would be entitled to a maximum reimbursement of €440 for emergency accommodation or canceled travel costs.
Exclusions from the Replacement Service or Reimbursement of Costs
HomeExchange is not required to find a replacement Property or reimburse the Guest Member for relocation or travel costs under the conditions outlined above in the following cases:
  • If the Exchange was to take place in a declared emergency zone (such as public health emergencies or epidemics), an area affected by ongoing military actions or other hostilities, or an area affected by a natural disaster (earthquake, hurricane, flood, etc.);
  • If the cancellation of the Exchange results from a force majeure event;
  • Or if the cancellation of the Exchange by the Hosting Member is justified by inappropriate behavior, non-compliance with the agreed conditions of the Exchange, or a violation of the Code of Conduct and these Terms by the Guest Member.
    1.5. Protection of Members in Case of Cancellation by HomeExchange
HomeExchange may occasionally need to cancel an Exchange in case of emergency, in other circumstances to avoid any harm to HomeExchange, any Member, or any third party, or for any other reason outlined in these Terms.
In this case, HomeExchange may, depending on the particular circumstances of the reason for the cancellation:
(i) refund the GuestPoints to the Guest Member;
(ii) allow the Hosting Member to retain all the GuestPoints attributable to the Exchange;
(iii) offer a replacement Property to the Guest Member; and/or
(iv) make any other reimbursement or payment it deems necessary.
1.6. Protection of Guests in Case of Insufficient or Inaccurate Property
A Property is considered insufficient or inaccurate based on the following criteria:
For any Property:
  • Absence of electricity;
  • Absence of running water;
  • Absence of hot water;
  • Absence of a refrigerator or malfunctioning refrigerator;
  • Absence of functional cooking elements (oven, stove, or microwave);
  • Significant presence of pests (rats, cockroaches, etc.);
  • Absence of toilets (or non-functional toilets);
  • Absence of a bathtub or functional shower;
  • Inability to close a ground-floor door or window leading to a public space (street, courtyard);
  • Faulty roof causing inadequate protection of the interior of the Property from rain; or
  • Sleeping capacity less than the number of people declared in the Exchange.
  1. When it has been expressly stated that the element would be provided:
  • Heating in occupied rooms unable to maintain a temperature above 19°C;
  • Air conditioning in rooms unable to maintain a temperature below 35°C;
  • Swimming impossible in indoor or outdoor pool during the designated season (lack of water or water quality issues);
  • Absence of Wi-Fi or Wi-Fi out of service;
  • Declared access for disabled persons not provided for one of the following rooms: bedroom, kitchen, bathroom, toilet, living room; or
  • Absence of an elevator or elevator out of service if the Property is located above the 3rd level of the building.
If a Guest Member is offered an insufficient or inaccurate Property, HomeExchange’s teams will make their best efforts to offer the Guest Member the possibility of staying in one or more replacement Properties with basic features as described in point 1.4 above.
If HomeExchange is unable to find one or more replacement Properties for the insufficient or inaccurate Property, the GuestPoints will be refunded by the Hosting Member to the Guest Member, and the Guest Member will be entitled to one of the following options:
  • Either relocation costs for a period equivalent to the planned Exchange, upon presentation of relocation invoices for the same dates as the canceled Exchange, up to €110/night (or €275/night for HomeExchange Collection services) and up to 15 nights, with a maximum reimbursement of €1,650 per canceled Exchange (or €4,125 per Exchange for HomeExchange Collection services);
  • Or travel costs for a canceled trip, upon presentation of invoices and cancellation and non-refund documentation, up to €110/night (or €275/night for HomeExchange Collection services), and up to 15 nights, with a maximum reimbursement of €1,650 per canceled Exchange (or €4,125 per Exchange for HomeExchange Collection services).
    1.7. Ratings, Responses, and Reviews
After an Exchange, both the Hosting Member and the Guest Member may leave feedback on the Property and the Guest Member, and submit a star rating, which will then be available on the Member’s Profile and/or in relation to the Member’s Listing. Both Hosting Members and Guest Members have 30 calendar days from the publication of the review or rating to contact HomeExchange and request that HomeExchange facilitates the publication of a response to the review or rating. Responses to reviews or ratings should not exceed 500 characters (including spaces).
These reviews, responses, or ratings reflect the individual opinion of Members and HomeExchange does not verify them nor guarantee their accuracy. Each Member who provides a review, response, or rating agrees to provide only accurate, non-defamatory, and non-offensive information. Reviews, responses, and/or ratings must not be made for the sole purpose of extortion or retaliation. Members cannot ask other Members to leave false reviews, responses, or ratings.
HomeExchange may decide to remove or refuse the publication of a review, response, or rating that is contrary to these rules. In case of removal of a review, HomeExchange will send an email to the concerned Member, explaining the reasons for the removal or refusal to publish the review. If the Member wishes to challenge this decision, they may file a complaint as outlined in Title IX User Content Moderation.

2. Electronic Messaging Service

HomeExchange provides Members and Registrants with a free electronic messaging service to facilitate an Exchange or share experiences regarding past Exchanges; however, the use of the messaging service alone does not allow Members to conclude an Exchange. The messaging service is automated, and as such, HomeExchange does not intervene in any way.
Members and Registrants are solely responsible for any information communicated through HomeExchange’s messaging service. No information exchanged between Members or Registrants through the messaging service binds HomeExchange in any way, and HomeExchange does not guarantee the accuracy or completeness of the information provided.

3. Automated Verification Service

HomeExchange provides its Members the option to conclude Exchanges with Verified Members.
HomeExchange offers an automated verification service for the name and address of each Member or Registrant when they create an Account. All Members or Registrants must provide proof of address and an identity document in order to verify their address and identity.
HomeExchange also verifies the phone number and email address of the Member or Registrant through an automated service.
The fact that the identity elements of a Member or Registrant, their email address, and phone number have been verified does not guarantee the accuracy or authenticity of any Content or Listing provided by that Member or Registrant. HomeExchange does not provide any guarantee or assurance regarding Verified Members or their Listings.

4. Deposit Management

HomeExchange offers a Deposit management service between the Hosting Member and the Guest Member, allowing the Hosting Member to protect themselves, either fully or partially, against the risk of theft, loss, or damage to their Property as described below.
The amount of the mandatory Deposit paid by the Guest Member is set at:
  • €500 for HomeExchange Members;
  • €2,000 for HomeExchange Collection Members when the Exchange is made with another Member of the Collection community.
The Deposit is pre-authorized on the credit card of the Guest Member when they participate in the Exchange. The pre-authorization occurs when the HomeExchange Membership payment is made.
In case of damage, loss, or theft, the Hosting Member must file a claim within ten (10) calendar days after the last day of the Guest Member’s stay at the Hosting Member's Property by filling out the form available here, including a description and estimated cost of the damage, loss, or theft, along with any relevant documentation.
HomeExchange will inform the Guest Member via email of the Hosting Member’s claim.
If the Hosting Member does not have all the required documentation within the ten-day period (e.g., if they are waiting for an estimate of repairs), they must request an extension from HomeExchange, which will not exceed thirty (30) days from the last day of the Guest Member’s stay. Any damage notice, theft or loss claim, or supporting evidence submitted outside of these time limits will be rejected.
Guest Members must respond to a claim notice or supporting evidence within ten (10) calendar days after receiving the notice.
In the case of a valid claim by a Hosting Member, the Guest Member’s failure to respond within the ten (10) day period constitutes an irrevocable waiver to contest the withholding of the claimed amount from the Deposit, which will be paid to the Hosting Member from the pre-authorized Deposit of the Guest Member.
If the Deposit is withheld or, if applicable, the damage evidence is provided within the applicable time frame, and if the Guest Member agrees with the damage estimate and the use of the Deposit, the agreed Deposit amount for the Exchange will be paid to the Hosting Member, at the latest, within twenty (20) working days from the confirmation of the agreement by both parties.
If the Guest Member's debit or credit card on file is declined at the time of payment, the Guest Member remains responsible for the Deposit amount and must pay it to the Hosting Member within five (5) calendar days by alternative methods: bank transfer, PayPal account, or any other valid debit or credit card.
If the Hosting Member and the Guest Member do not agree on the amount of the Deposit to be paid to the Hosting Member, HomeExchange will deduct the amount from the Guest Member’s credit card and hold it in escrow until joint instructions are issued by both the Hosting Member and the Guest Member confirming their mutual agreement on how the escrowed amount should be divided. If no agreement is reached within one (1) year from the date the Deposit was deducted, and if the Hosting Member provides no proof of legal action to recover the Deposit amount, HomeExchange will return the escrowed amount to the Guest Member. In case of legal action, HomeExchange will release the Deposit according to the terms of a final and binding court decision.
Although HomeExchange may intervene to facilitate the resolution of disputes between Members, it does not guarantee the Listings or the behavior of any Member or third party.
All Members agree to cooperate and make good faith efforts to assist HomeExchange and other Members in resolving any disputes that may arise in relation to an Exchange and to take any additional steps required to resolve such disputes.

7. HomeExchange Collection

The HomeExchange Collection Service is an organized set of Collection Properties.
Collection Members are required to have an active HomeExchange Collection Membership at the time of finalizing and during the Exchange in order to (i) participate in Collection Property Exchanges within the Collection program; and (ii) access services and benefits reserved for Collection Members. These exclusive services include, but are not limited to:
(1) A higher evaluation of the GuestPoints value of homes to reflect the premium nature of Collection properties;
(2) Priority Member service;
(3) Access to a community of Verified Members and carefully selected luxury homes;
(4) Eligibility for promotions, offers, and exclusive events;
(5) Enhanced security measures and guarantees for Collection Exchanges; and
(6) Other benefits that facilitate and encourage Exchanges within the Collection community.
All services reserved for Collection Members are exclusively offered as part of the HomeExchange Collection Membership package and cannot be sold separately. The service as a whole constitutes an electronic service provision.
Advantages
The HomeExchange Collection Service includes the following advantages as part of the main service of access to the Platform and the HomeExchange Collection area:
  • A luxurious new Platform design, accessible only to HomeExchange Collection Members,
  • The possibility to only be contacted by other HomeExchange Collection Members,
  • A filter to find other luxury homes within the community,
  • A dedicated Member support team via phone or email,
  • More personalized service quality,
  • Strengthened guarantees for matching the lifestyle and travel expectations of Members,
  • A professional photo retouching service offered during the first year of Membership,
  • An enhanced commercial guarantee in case of damages, theft, or other losses incurred by the Hosting Member.
Qualification
Collection Properties must feature unique and attractive characteristics that will provide Members with a superior experience compared to a standard Property. Hosting Members may apply to include their Property as a Collection Property within the HomeExchange Collection Service by filling out the form available here.
To determine whether a Property is eligible for Collection status, HomeExchange considers various factors, including but not limited to design, architecture, location, amenities, proximity to tourist destinations or attractions, as well as the Hosting Member’s status and reviews. The decision to list a Property as a Collection Property is at the sole discretion of HomeExchange. Similarly, HomeExchange may remove any Collection Property designation at any time, at its sole discretion and without liability to the Hosting Member.

V. Adhésion et Conditions de Paiement

Visitors can register for free, contact Members or Registrants, access the website, have limited access to the Listing Content (first photo, destination, Property description, Hosting Member's first name, profile photo), send messages to other Members or Registrants, and have their identity, email address, and phone number verified by HomeExchange.

Duration of Membership

The Membership is concluded for a period of 12 months from the date of subscription.
When subscribing to their Membership, the automatic renewal of the Membership for successive 12-month periods is activated by default. If a Member does not wish for the automatic renewal of their Membership, they can simply go to their Account and deactivate the "auto-renewal."
The Member will be notified no later than 30 days before the expiration of their Membership, by an email sent by HomeExchange to their email address, about the automatic renewal of their Membership for a period of 12 months.
To prevent the automatic renewal of their Membership, the Member can cancel their Membership on the last day of the current annual period by going to their Account and clicking on "Cancel my Membership."
Once the cancellation is done, the Member will receive a confirmation email regarding the cancellation of their Membership.
The cancellation will only take effect at the end of the current annual period.
As of the cancellation date, the Member will no longer have access to HomeExchange Services. If an Exchange was arranged after the expiration date of the Membership, the Exchange will be canceled if the Hosting Member or Guest Member has not renewed their Membership within 48 hours following HomeExchange's email reminder about the need to renew the Membership.
At the expiration of the Membership, the GuestPoints will be blocked on the Member's Account, and they will no longer be able to use them unless they reactivate their Membership, which the Member can do at any time as long as their Account remains active.

Membership Fees

In order to finalize Exchanges, it is mandatory for Registrants to become Members by subscribing to the HomeExchange Service Membership. Pricing details for the HomeExchange Service (Abonnements regular) are available here, and pricing details for HomeExchange Collection Services (Abonnement Collection) are available here.
The HomeExchange Service Membership is available in the form of an annual Membership, allowing Members unlimited access to Exchanges (within the limits of the available GuestPoints) during the validity period of the Membership mentioned above.
After the initial commitment period, the Membership price may be modified by HomeExchange.
The Member will be informed of any price changes before the automatic renewal, so they may cancel their Membership if necessary.
Any price change will take effect once it is communicated to Members or Registrants and will apply to any future purchases made by a Member or Registrant after the change comes into effect.

Taxes and Fees

Prices are indicated in the currency of the Member's country of residence, including all taxes. HomeExchange is in no way responsible for any fees, banking charges, or credit card fees incurred by the Member related to the payment of Services via the Platform.
In accordance with the provisions of Article 58 of VAT Directive 2006/112/EC, transposed into Article 259, B 12° of the French General Tax Code, the Membership allowing the Member to access the Platform constitutes an electronic service.
When the Member subscribing to the Membership is located in another European Union Member State, this service is subject to VAT at the place where the Member or Guest making the payment is domiciled.
The applicable VAT rate is that of the location of the Member or Guest. When applicable, VAT due outside France is collected by HomeExchange and redistributed to the various tax administrations via the One Stop Shop (OSS).
When the Member or Guest subscribing to the Membership is located in a non-EU Member State, this service is not subject to EU VAT. However, it is possible that a VAT or equivalent tax is applicable depending on the location of the Member and local rules. In such cases, HomeExchange will declare and pay the VAT or equivalent local tax to the relevant tax authorities.

Payment of Membership

Membership payments can be made by credit or debit card, or via PayPal (subject to the additional conditions imposed by PayPal). All payments are non-refundable, unless a Member requests the cancellation of their Membership within 14 calendar days following their subscription, subject to the limitations and conditions specified in the next section.
The first annual Membership may be paid in 3 installments (not applicable to HomeExchange Collection) via credit card. This offer is reserved for Members or Registrants making their payment in Euros (€) and holding a valid credit card at least 90 days after the date of purchase. The first installment is paid at the time of purchase, and the subsequent two installments are automatically charged 30 and 60 days later. By choosing this option, the Member agrees to pay the total amount of the Membership, plus service fees, which will be indicated at the time of payment.

Membership Refund

In accordance with the provisions of Article L221-28 1° of the French Consumer Code, the legal right of withdrawal cannot be exercised since the Member can use the entire Platform before the withdrawal period ends. As a result, HomeExchange’s performance of its services will have already begun.
The Member expressly agrees to the immediate commencement of their Membership and is aware that upon subscribing to their Membership, they lose their right of withdrawal.
However, HomeExchange offers, as a purely commercial gesture, the possibility for Members or Registrants to cancel, for any reason, free of charge, within fourteen (14) days following the start of their Membership, provided that no Exchange has been scheduled for that Member or Registrant. In case of payment in 3 installments via credit card, the Member or Registrant has fourteen (14) calendar days from their first payment. To cancel their Membership, the Member or Registrant must complete the form available here (Contact formulaire).
HomeExchange will acknowledge receipt of the Membership refund form via email.
HomeExchange commits to refunding the Member or Registrant the Membership amount using the payment method originally used by the Member or Registrant within 14 days of being informed of the Member or Registrant's decision to withdraw.

VI. Insurance

Hosting Members are solely responsible for obtaining and maintaining valid insurance for property owners, tenants, or any other insurance required by law or applicable contracts, in relation to the Exchange and any equipment involved. This insurance must remain valid and in force for the entire duration of the Exchange. Any failure to maintain this insurance may result in the immediate cancellation of a Hosting Member's Account. Furthermore, HomeExchange may request that a Hosting Member promptly provide proof of this insurance and any other information related to this request. Any failure to respond or provide accurate information may result in the cancellation of the Member's Account.
It is the Members' responsibility to review and understand their own insurance coverage, the coverage provided by any other Member with whom a Member participates in an Exchange, property insurance, and liability insurance. You remain solely responsible if your participation in an Exchange violates any agreement or policy with your insurance provider.

VII. Platform and Content for Limited Purpose Only; Prohibition of Spam

The Platform must not be used for solicitation or commercial purposes. Data mining from the Platform and/or the collection or storage of personal information about Members and Registrants is strictly prohibited.
Any attempt to collect or use personal information from Members and Registrants, or to contact Members and Registrants or groups of Members and Registrants for purposes other than organizing an Exchange, constitutes a violation of these Terms.
Inquiries and communications may be monitored and filtered by HomeExchange before being transmitted to Members and Registrants. HomeExchange is not responsible for undelivered requests or loss of revenue resulting from undelivered requests.
We may review communications sent between you and other Members and Registrants that are not easily accessible to the general public to verify their compliance with these Terms, but we will treat them as private communications. You remain solely responsible for the Content you post and the communications you exchange.
HomeExchange does not participate in sending unsolicited commercial emails ("SPAM") and does not tolerate it.
HomeExchange reserves the right to delete (without refund) the Account of any Member or Registrant who mentions HomeExchange or any of its websites, URLs, or any HomeExchange-associated email addresses in a spam message. HomeExchange also reserves the right to delete (without refund) the Account of any Member or Registrant who uses HomeExchange to send solicitations other than personal requests or responses related to an Exchange. If the Member or Registrant wishes to file a complaint, they must follow the procedure outlined in Title IX: User Content Moderation.

VIII. Intellectual property rights and copyrights

The Platform contains areas where you or other Members or Registrants may post or submit information, including texts, photographs, images or other information (the "User Content").
Ownership of User Content
User Content is either your property or the property of the person who created it. Please do not post User Content without obtaining permission from the person who took the photo and from any individual or the Property depicted in the photo.
Responsibility
It is your responsibility to determine whether the User Content or information is protected by copyright, patent, trademark, trade secret, right of publicity, or any other industrial or intellectual property rights. Except for information in the public domain or for which you have received express written permission, you agree not to upload, post, or transmit any User Content or information protected by copyright, patent, trademark, trade secret, right of publicity, or any other industrial or intellectual property rights without the express permission of the owner of such rights.
You are solely responsible for any damage resulting from a violation of copyrights, patents, trademarks, trade secrets, right of publicity, or other industrial or intellectual property rights or any other harm resulting from such a submission, and you agree to indemnify, defend (at our request), and hold HomeExchange harmless from any claims or losses it may incur due to your violation of any provision in this section.
We assume no responsibility or express or implied approval, and we expressly disclaim all responsibility for the conduct of Guests or Members or Registrants, or for the views, opinions, or statements expressed in any User Content on the Platform. You use the Platform and view User Content strictly at your own risk.
We reserve the right to delete your Account or User Content at any time if your conduct or User Content violates applicable law and the rules outlined in these Terms and/or harms the Platform’s security or the security of Members or Registrants. In this case, you will receive an email explaining the reasons for the decision to delete your Account or User Content. If you wish to contest this decision, you can file a complaint (see Title IX: User content moderation).
Ownership of platform content
Except for User Content, HomeExchange holds all intellectual and industrial property rights related to the content of the Platform.
You agree not to copy, modify, translate, display, distribute, download, transmit, sell, redistribute, publish, or create derivative works from any content appearing on the Platform, including the Platform and User Content, without our prior written consent, unless it is your own User Content that you legally publish on the Platform.
Application
Subject to your compliance with these Terms, HomeExchange grants you a limited, non-exclusive, non-sublicensable, revocable, and non-transferable license to (i) download and use the Application on your mobile phone, tablet, or other personal devices; and (ii) access and view any content on the Platform made available to you through the Platform, solely for your personal and non-commercial use.

IX. User Content Moderation

NOTIFICATION AND MODERATION OF USER CONTENT TUKAZZA!, a company in the HomeExchange group, is the host of the Services and the holder of the Platform within the meaning of Regulation 2022/2065 of October 19, 2022 ("Digital Services Act").
HomeExchange is not responsible for information stored on the Platform by a Registrant or Member, provided that HomeExchange:
a) Has no actual knowledge of the illegal activity or illegal content, and in the case of a claim for damages, has no awareness of facts or circumstances that would make the illegal activity or content apparent; or
b) Once it becomes aware, acts promptly to remove the illegal content or make access to it impossible.
HomeExchange is not under any general obligation to monitor the information that Members or Registrants transmit or store, or to actively search for facts or circumstances revealing illegal activities.
HomeExchange reserves the right to conduct voluntary targeted investigations to detect, identify, and remove or disable access to illegal content or content that violates these Terms, and to take all necessary actions in accordance with these Terms.
The Member or Registrant agrees to cooperate with HomeExchange and assist in good faith by providing the required information and taking reasonable actions concerning Content on the Platform or the misuse of the Platform.
If Registrants or Members detect illegal content or content that violates these Terms, they may click "Report Abuse" or contact the dedicated reporting service at the following email address: moderation@homeexchange.com.
The report should include the exact location of the Content, a description of the reasons for the report, and any supporting evidence.
Once we receive your report, the HomeExchange support team:
  1. Reviews the situation in detail,
  2. Determines if the Content violates the Agreement or the law,
  3. Sends a response to the Member or Registrant who reported the Content.
HomeExchange uses an automated system including several algorithms that detect certain words, expressions, Listings, or behaviors that may indicate Content contrary to the law or these Terms.
This system does not moderate Content and is limited to flagging problematic Content to the moderation team.
Each detected Content is subject to human review before HomeExchange takes corrective action.
HomeExchange commits to addressing reports within a reasonable time and in proportion to the severity of the risk.
Depending on the severity, HomeExchange may take the following actions:
  • A warning sent to the reported Member or Registrant to remind them of the obligation to comply with applicable laws or these Terms;
  • Removal of abusive Content (message, image, Listing text);
  • Temporary or permanent removal of the Listing;
  • Suspension or deletion of the Account in case of severe abuse or repeated violations;
  • Cancellation of upcoming Exchanges;
  • Reporting the Content to the competent authorities.
If we take any of the corrective actions outlined above or suspend or close your Account, we will notify you by email, specifying the facts, legal grounds on which we based our decision, and the remedies available to you.
INTERNAL CLAIMS HANDLING SYSTEM
We provide you with a free internal mechanism for handling claims.
If you disagree with a corrective action we have taken, you can file a complaint by responding to the last email you received from our support team.
In your appeal, you must clearly explain why you believe our decision is unjustified and include any supporting evidence.
We commit to acknowledging receipt of your complaint and responding within a reasonable timeframe.
Any misuse of our reporting systems, such as submitting false or malicious reports, may result in the suspension of your Account.
RÈGLEMENT EXTRAJUDICIAIRE DES LITIGES
In addition to the internal claims handling system, you may use a certified out-of-court dispute resolution body in accordance with the Digital Services Act. A list of such bodies is available here.

The Platform may contain links to other websites maintained by third parties, or integrate services provided by third parties ("Third-Party Services"). These Third-Party Services are provided solely for your convenience. HomeExchange has no control over, and assumes no responsibility for, the Content, products, or services offered by Third-Party Services or found on related websites, or for their terms of use or privacy policies. Members or Registrants are solely responsible for complying with the terms of use and/or privacy policies of these Third-Party Services. Links to third-party sites do not constitute an acceptance of responsibility or a sponsorship, endorsement, or approval of these sites or their content.

XII. Disclaimer of Warranties

You use the Platform and any information obtained through the Platform at your own risk. HomeExchange makes no express or implied warranties regarding the Exchanges and/or the personal or real property included in Listings or Exchanges available on the Platform. HomeExchange makes no warranties of any kind, either express or implied, regarding the Listings, other Members or Registrants.
HomeExchange does not conduct background checks or request references from its Members or Registrants. HomeExchange makes no representation or warranty regarding the conduct of Members or Guests, or the suitability of a Member’s or Registrant’s property listed in a Listing.
ACCEPTANCE OF RISK: You assume full responsibility and risk for your use of the Platform and any information obtained from or through the Platform, including your interactions with other Members or Registrants, the Exchanges in which you participate, and your use of other Services provided by HomeExchange. You use the Platform on a voluntary basis and at your own risk.
HomeExchange cannot guarantee the continuous and uninterrupted availability or accessibility of the Platform. HomeExchange has the right to restrict or limit access to the Platform as necessary to protect its servers or to perform maintenance.
The opinions, advice, statements, offers, or other information or content made available through the Platform, but not directly by us, are the property of their respective authors and should not necessarily be considered.
We do not guarantee the accuracy, completeness, or usefulness of any information on the Platform and are not responsible for the accuracy or reliability of any opinion, advice, or statement made by any party other than us. We are in no way liable for losses or damages resulting from reliance on information or other content published on the Platform or transmitted to Members or Registrants.

XIII. Dispute Resolution

This section addresses the resolution of conflicts related to the execution of the Services and these Terms between HomeExchange and its Members or Registrants.
Conflicts regarding content moderation are addressed in Title IX: User Content Moderation.
Internal Complaint Procedure
You can file a written complaint with our customer service by contacting the Chatbot or filling out the form available here.
Your written complaint must specify the facts and reasons for the dispute and include any supporting evidence.
We commit to acknowledging receipt of your complaint within a reasonable time. We will contact you by phone or email.
Mediation
In accordance with Article L. 612-1 of the Consumer Code, the Member or Registrant, subject to Article L.612-2 of the Consumer Code, has the option to request amicable resolution through mediation, within one year from their written complaint to HomeExchange.
HomeExchange has designated, by registration number 17556/VM/2512, SAS Médiation Solution as the consumption mediator entity.
To contact the mediator, the Member or Registrant must submit their request:

Regardless of the method used, the request must include:
  • The Member or Registrant's postal, telephone, and email contact details,
  • The name, address, and registration number of HomeExchange with SAS Médiation Solution,
  • A brief description of the facts,
  • A copy of the prior complaint,
  • Any documents supporting the request (order form, invoice, payment proof, etc.).
Disputes with Other Members or Registrants
When Members conclude an Exchange, they enter into a contract containing obligations they must fulfill.
Members are responsible for the performance of their obligations and bear sole responsibility for any risks related to the provision or occupation of a Property in connection with an Exchange, including the risk of damage to property or theft of certain items that furnish it.
Disputes with Third Parties and Disclaimer
You remain solely responsible for any claim, demand, or damage arising from the violation of agreements or obligations to third parties to which you or your property are subject, including, but not limited to, licenses, rental contracts, insurance policies, regulations of owners' associations, regulations of condominium or cooperative boards, and national and local laws.

XIV. Applicable Law

These Terms are governed by and interpreted in accordance with French law, subject to the application of more protective provisions of mandatory legal regulations for consumer protection in the Member or Registrant's country of residence.

XV. Miscellaneous

Severability
If any part of these Terms is illegal, invalid, unenforceable, or prohibited in any respect under applicable law or regulation, such provision or part shall be deemed not to form part of the contract between us. The legality, validity, or enforceability of the rest of these Terms will remain fully in effect.
No Waiver
No failure or delay by HomeExchange in exercising any right, power, or privilege under these Terms will constitute a waiver of that right, power, or privilege, and no single or partial exercise of any right, power, or privilege will prevent any further exercise of it or the exercise of any other right, power, or privilege under these Terms.
Assignment
HomeExchange may assign its rights and obligations under this contract without your prior consent and without informing you, provided that such assignment does not reduce your rights. You may not assign this Agreement without HomeExchange’s prior written consent.
Modification
These Terms may be modified by HomeExchange.
The Member or Registrant will be informed at least thirty (30) days before the new Terms enter into effect through email notifications.
The Member or Registrant will be required to explicitly accept the updated Terms.
Entire Agreement These Terms and its Annexes constitute the entire agreement between HomeExchange and you regarding the subject matter of these Terms.

HOMEEXCHANGE.COM INC. TERMS OF SERVICES

These Terms are applicable to website visitors, Members and Registered Users of the Platform residing in the Americas (United States, Canada, Latin American countries), United Kingdom, Australia, New Zealand, and Asia.
We may periodically update our Terms. These changes will apply to you if you continue to use the Platform at any time after the changes are implemented. If you do not agree with the updated Terms, do not access the Platform.
We provide links to important and useful information in these Terms, including our FAQs, where you will find answers to some of the questions most frequently asked by our members and users.
PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE PLATFORM. THESE TERMS CONTAIN PROVISIONS THAT LIMIT OUR LIABILITY (SECTIONS XI, XII AND XIII) AND THAT PROVIDE THAT YOU AND HOMEEXCHANGE SHALL RESOLVE ANY DISPUTES BETWEEN THE PARTIES BY BINDING ARBITRATION WITHOUT A JURY (SECTION XIV). NOTWITHSTANDING THIS, IF YOU ARE A UK CONSUMER, THE FOLLOWING MARKED “UK-SPECIFIC” PROVISIONS SHALL APPLY TO YOU AND PREVAIL WHERE THEY PROVIDE GREATER PROTECTION.
BY USING THE PLATFORM, CREATING AN ACCOUNT, AND/OR PURCHASING ANY MEMBERSHIP ON OUR PLATFORM YOU REPRESENT THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BOUND BY AND COMPLY WITH THESE TERMS.

UK SPECIFIC: UK CONSUMERS

IMPORTANT STATUTORY RIGHTS IF YOU ARE A CONSUMER RESIDENT IN THE UNITED KINGDOM: THESE TERMS ARE SUBJECT TO YOUR STATUTORY RIGHTS UNDER UK LAW, INCLUDING THE CONSUMER RIGHTS ACT 2015, WHICH CANNOT BE LIMITED OR EXCLUDED. THE ARBITRATION AGREEMENT, CLASS ACTION WAIVER, JURY TRIAL WAIVER, AND NEW YORK JURISDICTION PROVISIONS IN THESE TERMS DO NOT APPLY TO YOU. YOU MAY BRING CLAIMS IN THE COURTS OF ENGLAND AND WALES, SCOTLAND, OR NORTHERN IRELAND (DEPENDENDING ON YOUR RESIDENCE). NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR ANY OTHER MATTER THAT CANNOT LAWFULLY BE EXCLUDED UNDER UK LAW.

Some important points:

  • You are only permitted to use the Platform if you are at least eighteen (18) years of age and capable of entering into legally binding contracts. By accessing the Platform, you represent and warrant that you are eighteen (18) years of age or older and are capable of entering into legally binding contracts.
  • We operate in most countries, but not all, so certain restrictions may apply to our ability to offer you our services through the Platform and your ability to use the same.
  • You represent and warrant that (i) you are not located in, nor a citizen of, any country or jurisdiction subject to an embargo or government sanctions, or that has been designated as a state sponsor of terrorism by the US government, and that (ii) you are not, and have never been, included on any list of prohibited, sanctioned, or restricted parties maintained by the US government, including the Specially Designated Nationals and Blocked Persons List maintained by the US Department of the Treasury.
  • Your decision to host, exchange, and travel is yours alone. Government agencies, such as the US Department of State, may issue travel advisories for certain countries or regions of the world regarding safety, crime, and other dangers that may pose a risk to visitors of the area. You are solely responsible for consulting these resources before travelling.
  • You are solely responsible for determining the laws, rules, or regulations that apply to you and for ensuring that you understand and comply with those rules in connection with offering your Accommodation for an Exchange, including whether licenses, permits, or other registrations are required before entering into an Exchange. HomeExchange does not provide legal advice, so please seek independent legal advice if you have any questions about compliance.
  • Similarly, it is the sole responsibility of Host Members to provide and communicate to Guest Members all information necessary or desired for the proper use of the Accommodation and all devices, features, and equipment included therein (e.g., swimming pools, lights, and HVAC systems).

I. DEFINITION OF TERMS

  • “Accommodation” means any permanent residential property (excluding, among other things, motorhomes, boats, mobile homes and other non-permanent residential structures) that a Member has the legal and/or contractual right to offer via the Platform.
  • “Account” refers to the account that must be created to enable an individual to access the Services offered by the Platform.
  • “Code of Conduct” means the set of rules of good conduct and behavior expected of members of the HomeExchange community before, during, and after an Exchange.
  • “Collection Accommodation” means a unique Accommodation carefully selected by HomeExchange based on a list of predefined criteria in Section IV, point 7.
  • “Collection Member” refers to a Member who has subscribed to the HomeExchange Collection Services and who enjoys unlimited Exchanges for Collection Accommodations during the 12-month validity period of the Collection Membership.
  • “Collection Membership” means a Collection Member's subscription to the HomeExchange Collection Services for a period of twelve (12) months in exchange for the payment of the Collection Membership price.
  • “Exchange” means an exchange of Accommodations agreed between a Host Member and a Guest Member. Exchanges may be: (i) simultaneous with another Exchange of Accommodation agreed by the same Guest Member and the same Host Member, under which the Guest Member also lends their Accommodation to the Host Member while simultaneously staying at the Host Member’s Accommodation, (ii) non-simultaneous reciprocal exchange of Accommodations agreed between two Members, or (iii) a unilateral Exchange for GuestPoints, independent of any other Exchange.
  • “Force Majeure Event” means any event or circumstance beyond the reasonable control of the affected party which prevents or delays the performance of its obligations under these Terms, and which: (a) was not reasonably foreseeable at the date when it occurred and (b) could not have been avoided or overcome by the affected party acting reasonably. Without prejudice to the generality of clause this definition, Force Majeure Events include (but are not limited to): (a) acts of God, flood, drought, earthquake, storm, lightning, fire or explosion; (b) epidemic, pandemic or other widespread outbreak of infectious disease; (c) war, threat of war, armed conflict, invasion, terrorism, civil war, civil commotion or riots; (d) nuclear, chemical or biological contamination; (e) acts of any governmental or other competent authority, including but not limited to imposition of export or import restrictions, embargoes, sanctions, expropriation or nationalisation; (f) general labour disputes affecting the industry as a whole (but excluding strikes or other industrial action specific to the affected party or its direct contractors).
  • “Guest Member” refers to a Member who enters into an Exchange with a Host Member.
  • “GuestPoints” (also referred to as “GP” throughout the Platform) refers to the points accumulated by Members, the functioning of which is described in more detail in Section IV “HomeExchange Services” point 1.2 “GuestPoints.”
  • “HomeExchange Collection Services” means the services provided by HomeExchange to Collection Members as described in Section IV.
  • “HomeExchange Services” means the services provided by HomeExchange to Members as described in Section IV.
  • “Host Member” refers to a Member who offers their Accommodation as part of an Exchange.
  • “Listing” means the posted offering of an Accommodation on the Platform by a Member or Registered User, including all associated descriptions, images, details provided, and any User Content used on the Listing. Each listing has a unique identification number on the Platform.
  • “Member” refers to a Registered User who has purchased a Membership to the HomeExchange Services and who benefits from unlimited access to Exchanges during the 12-month validity period of the Membership.
  • “Membership” means a Member's subscription to the HomeExchange Services for a period of twelve (12) months in exchange for the payment of the Membership price.
  • “Platform” refers to the website www.homeexchange.com and any HomeExchange Application for mobile phones, tablets, and other personal devices.
  • “Registered User” refers to any person who registers for an Account on the Platform.
  • “Security Deposit” means the security deposit, as described in more detail in Section IV “HomeExchange Services”, point 4 “Management of Security Deposits.”
  • “UK Consumer” means a visitor to the Platform, a Registered User, or a Member who accesses the Platform, or uses the Platform and the offered services in any way who is a resident in United Kingdom.
  • “User Content” refers to the information provided by the Host Member in their Listing.
  • “Verified Account” means a Registered User’s or Member’s account on which the identity (first and last name), email address, phone number, and Accommodation address have been confirmed by HomeExchange through its automated verification service.
  • “We,” “our,” “ours” and “HomeExchange” refer to HomeExchange.com Inc. or any company within the HomeExchange group.
  • “You,” “your,” and “yours” refer to you, as a visitor of the Platform, a Registered User, UK Consumer or a Member who accesses the Platform, or uses the Platform and the offered services in any way.

II. GENERAL USE OF THE PLATFORM

Your use of the Platform is subject to your compliance with these Terms, including our Code of Conduct, which you must strictly adhere to and which reflects the fundamental values of our community.
When using the Platform, you agree:
  • Not to provide false or misleading information when registering for an Account or to any Registered User, Member, or HomeExchange.
  • Not to create multiple Accounts or fake Accounts.
  • Not to post on the Platform, or transmit to others through the Platform, any material or communication that is defamatory, inaccurate, abusive, obscene, vulgar, offensive, sexual, threatening, harassing, racist, discriminatory or illegal, or any material that infringes or violates the rights of another party (including, but not limited to, intellectual property rights and rights to privacy and publicity).
  • Not to use the Platform to violate any applicable law, discriminate against another Member, Registered User, or third party, engage or participate in fraudulent transactions, publish or send any content or engage in any conduct that exposes a Registered User, a Member, or HomeExchange to any liability.
  • Not to upload or transmit through the Platform files containing viruses, corrupted files, Trojan horses, malicious codes, or any other similar software or programs that may harm HomeExchange, the operation of another person’s computer, or gain unauthorized access to that computer.
  • Not to accept payment from a third party in exchange for conducting commercial activity on the Platform in violation of these Terms without the express authorization of HomeExchange.
  • Not to allow anyone to use your Account, except as expressly provided herein.
  • Not to interfere with another Member's or Registered User's Account, circumvent measures designed to prevent or restrict access to the Platform, or use indexing robots, other robots, or “scrapers,” to collect content from the Platform, other Members, and Registered Users.
  • Not to collect, obtain, or use in any way information about other people, including email addresses, without their consent.
  • Not to offer Accommodations to Members or Registered Users for rent.
  • Not to exchange an Accommodation with a Member or a Registered User outside the Platform.
You also agree that:
  • You assume full responsibility for your use of any information published on the Platform.
  • You have the right to publish a Listing and offer your Accommodation for Exchange.
  • You are solely responsible for your communications and interactions with other Members or Registered Users.
  • If you believe in good faith that a Member or Registered User is violating these Terms or has acted inappropriately or illegally, you must immediately report that Member or Registered User to HomeExchange and, if necessary, to the competent legal authorities. However, no report made to HomeExchange and/or the legal authorities obliges HomeExchange to act in any particular way, unless required by law.

III. MEMBERSHIP RULES

1. CREATING AN ACCOUNT

In order to register on the Platform, you must first create an Account by providing the personal information requested, namely your name, year of birth, telephone number and email address.
You may only create one Account for yourself and for the people with whom you share the Accommodation with. If several people live in or own the same Accommodation, said Accommodation may only be offered for Exchange from a single Account. Any exception to this rule must be approved in writing by HomeExchange in advance.
You may choose to treat individuals above the age of eighteen (18) residing in said Accommodation as authorized users of your Account, as long as they reside with you.
Members and Registered Users must keep their Account information up to date at all times. HomeExchange shall not be held liable for any incorrect or fraudulent information provided by Members or Registered Users. At the time of registering your Account, you must: (i) be eighteen (18) years of age; (ii) have the right to offer the Accommodation via the Platform and continue to have this right during your use of the Platform; and (iii) be capable of entering into an Exchange. Furthermore, an Account is for the exclusive and personal use of that Member and the people with whom you share your main Accommodation, and no Account may be created for professional or commercial purposes.
HomeExchange reserves the right to refuse you the creation of an Account at its sole discretion, for any reason, and at any time.
Upon creation of an Account, individuals provide an authentication email address and password, which may only be changed at the individual’s request. Each Member and Registered User is solely responsible for maintaining the confidentiality of their login credentials and agrees not to disclose them to anyone, under any circumstances or for any reason.
Each Member or Registered User is solely responsible for any use by a third party of their Account and for any action or statement made by a third party through their Account, whether fraudulent or not, and releases, defends, and holds HomeExchange harmless from any liability in relation to any claims in this regard. Furthermore, HomeExchange declines all responsibility in the event of identity theft of a Member or Registered User. If a Member or Registered User has reason to believe that a third party is fraudulently using their identity or otherwise using their Account in an unauthorized manner, the Member or Registered User must immediately notify HomeExchange. In the event of loss or theft of the Account login credentials, the Member or Registered User must immediately change the Account login credentials, and the Member or Registered User shall be solely responsible for any damage related to such loss or theft.
Members or Registered Users are not and shall not be considered employees, agents, joint ventures, or partners of HomeExchange for any reason whatsoever, and all Members or Registered Users act exclusively on their own behalf and for their own benefit. HomeExchange does not control or direct Members or Registered Users in any way, and each Member or Registered User acknowledges and agrees that they are posting a Listing or participating in an Exchange freely and at their sole discretion.
If you register your Account using a third-party social networking service (Google, Microsoft, Facebook, etc.), you may disable the connection between your social networking account and HomeExchange through your Account settings.

2. ACCOUNT VERIFICATION

When creating an Account, all individuals must provide proof of address and identity. Documents are verified using an automated system. The sole purpose of this automated processing is to confirm the authenticity of the documents provided and their consistency with the information declared by the individual.

HomeExchange also verifies the phone number and email address of the Members and Registered Users using an automated system. Any email address or phone number that has been verified will be designated as such in the profile of the relevant Member or Registered User.
Once a Member’s or Registered User’s identity, address, phone number, and email address have been verified, they will be designated as a “Verified” on their profile.
In the event of failure of the automated verification or suspicion of fraud, HomeExchange reserves the right to request additional verification, suspend, or delete the Member's or Registered User’s Account.
Only individuals with a Verified Account will be able to finalize Exchanges on the Platform.
The mere fact that a Member's or Registered User’s identity, address, phone number, and email address have been verified by our automated service does not guarantee the accuracy or authenticity of the information and any Listing provided by that Member or Registered User. HomeExchange cannot be held responsible for the information provided by Members or Registered Users on their Listings.

3. ANTI-DISCRIMINATION POLICY

By registering with HomeExchange, Members and Registered Users agree to comply with the Code of Conduct and this Anti-Discrimination Policy.
Members and Registered Users are prohibited from discriminating against others on the basis of the following protected characteristics: regardless of race, age, ethnicity, color, religion, national origin, language, sex, pregnancy, sexual orientation, gender identity, familial status, marital status, caste or disability. Members and Registered Users may not treat other Members or Registered Users differently or refuse such Member or Registered User’s stay because of their protected characteristics or the perception that they have a protected characteristic.
HomeExchange reserves the right to suspend or terminate the membership of any Member who engages in discriminatory or illegal behavior.
Certain jurisdictions may have additional legal requirements that extend or limit civil rights protections. It is Members’ and Registered Users’ responsibility to understand and follow laws or regulations that apply to them. To the extent that this policy is more protective and does not otherwise conflict with applicable law, we expect Members and Registered Users to adhere to this policy. Compliance with HomeExchange's anti-discrimination policy is mandatory, and we ask Members and Registered Users to contact our support team with any questions or concerns.
If a Member or Registered User feels they have been discriminated against, or wishes to report a user, profile, listing, or message for discriminatory behavior, they may file a report by contacting HomeExchange support@homeexchange.com.

4. LISTINGS

Members must keep their Listings up to date and accurate at all times, including:
  • Any User Content included in the Listing;
  • The description, location, and dates of availability of the Accommodation;
  • Necessary and essential information about the Accommodation and its authorized use by the Guest Member, its features, and amenities (e.g., swimming pools, lighting and HVAC systems, security devices, etc.)
An Accommodation may only appear on the Account of a single Member or Registered User, even if several people have rights to that Accommodation. Listings may not contain hyperlinks.
HomeExchange reserves the right to require that certain minimum information be included in a Listing and that the information in the Listing be presented in a specific format.
The placement of Listings in HomeExchange search results may vary and depends on various factors related to (i) the user’s profile information (such as age, Member or Registered User status, number of available GuestPoints, etc.), (ii) the details of the Listing (such as the description of the Accommodation, its availability, its GuestPoints value, etc.), (iii) the activity of the Member or Registered User on the Platform (such as the number of logins, the response rate, the number of calendar updates, etc.) and (iv) the preferences identified by the Member or Registered User (such as the Accommodations marked as favorites, etc.). HomeExchange makes no guarantee as to the specific placement of a Member's or Registered User's Listing in the search results.
All Members and Registered Users represent and warrant that the publication of a Listing and any acceptance of an Exchange for a Host Member's Accommodation will not violate any agreements that such Member or Registered User has entered into including, but not limited to, agreements with a co-owners' association, owners' association, and cooperative agreements.
All Members and Registered Users further represent and warrant that their Accommodations and Listings shall be compliant with all applicable laws, including zoning laws, tax requirements, or licensing or permit requirements, or any other laws, rules, or regulations applicable to the Accommodation or the Listing. All Host Members are responsible for their own acts or omissions or those of any person present in the Accommodation, other than the Guest Member and their guests.
All Host Members are responsible for their own acts or omissions in the drafting of their Listings.

5. CLOSING AN ACCOUNT

5.1. Accounts closed by HomeExchange
If a Member or Registered User (i) acts in violation of these Terms or any other rules published by HomeExchange, (ii) behaves in a manner contrary to our Code of Conduct, our values or our ethics, or (iii) violates any law, rule, regulation or other legal order issued by a competent jurisdiction, HomeExchange reserves the right, without justification, without warning or notice, and without compensation, to:
  • restrict that Member's or Registered User's access to the Platform;
  • suspend that Member's or Registered User's access to the Platform
  • remove any User Content published on the Platform; or
  • close an Account;
  • cancel upcoming Exchanges;
  • report the relevant incident to the competent authorities.
By closing an Account, HomeExchange does not waive any of its rights in relation to such incident.
The closure of a Member's Account will result in the immediate termination of the Member's current Membership, without any right to a refund, even partial, of the Membership fee. All GuestPoints accumulated by this Member will be cancelled and permanently lost.
In the event of Account closure by HomeExchange, the Member or Registered User will receive an email notifying them of the reasons for such a decision. The Member or Registered User may file a complaint in accordance with the procedure set out in Section XIV “Dispute Resolution.”
HomeExchange reserves the right to disconnect, terminate, delete or empty your Account, all associated Listings and all related information from the Platform and our servers after a period of inactivity of three (3) years, in accordance with our Privacy Policies.
5.2. Closing an Account at the request of a Member or Registered User
Members or Registered Users of the Platform may, at any time and for any reason, terminate their registration on the Platform by requesting the closure of their Account. To cancel an Account, a Member or Registered User must complete the form available here.
As detailed below, any request to close an Account by a Member after the expiration of the applicable 14-day period will not result in any refund, even partial, of the amounts paid for a Membership in relation to that Account.
The request to close the Account will take effect one (1) working day after HomeExchange receives it, and all future Exchanges will be cancelled; however, if an Exchange is in progress on the date of the request, the Account will not be closed until the Exchange and all related transactions have been completed. HomeExchange will confirm the closure by sending an email to the former Member or Registered User at their email address.
Upon closure of a Member Account, all GuestPoints accumulated by that Member will be cancelled and permanently lost.

IV. HOMEEXCHANGE SERVICES

Members must pay their Membership fee before participating in their Exchange and in order to benefit from the HomeExchange Services.
The HomeExchange Services includes the following services:
  • access to the Platform enabling Members to carry out Exchanges (see point 1 below),
  • access to the HomeExchange electronic messaging service (see point 2 below),
  • the automated verification service prior to the conclusion of an Exchange (see point 3 below), and
  • security deposit management (see point 4 below) and
  • email and/or chatbot assistance in emergency situations 24 hours a day, 7 days a week (see point 5 below).
All HomeExchange Services are indivisible and cannot be subscribed to individually. In addition, specific services and benefits are reserved for Collection Members (see point 7 below).

1. ACCESS TO THE PLATFORM

1.1 General description of the main service provided
HomeExchange provides its Members with access to the Platform connecting Members, allowing Host Members to publish a Listing to offer an Exchange of their Accommodation, and allowing Guest Members to view the Listing and book the Accommodation offered for Exchange by a Host Member.
HomeExchange is simply a platform for connecting people. When Members enter into an Exchange, they enter into a contractual relationship directly with each other. HomeExchange does not become a party to any Exchange, and HomeExchange is not a real estate broker or agent insurer. HomeExchange does not receive any compensation for Exchanges conducted between Members.
Members who wish to make an Exchange via the Platform do so on their own initiative and under their own responsibility.
HomeExchange does not act as an agent of any kind for a Member during an Exchange, unless expressly stated otherwise herein. The exchange management services provided by HomeExchange are automated. As such, all contact between Members is initiated solely on the basis of the efforts of the Members, and HomeExchange does not intervene in any way, unless expressly stated otherwise herein.1
Each Exchange constitutes a limited authorization granted by a Host Member to2 a Guest Member to enter, occupy, and use the Accommodation during the specified period. To the extent permitted by applicable law, Host Members reserve the right to repossess the Accommodation. If a Guest Member fails to vacate the Accommodation at the end of the defined Exchange period, the Host Member may take all applicable legal measures to compel them to vacate the Accommodation. The Member Guest undertakes to pay, for each additional 24-hour period during which they have not vacated the Accommodation, all compensation claimed by the Host Member in connection with the Guest Member's failure to vacate. Guest Members authorize HomeExchange to pay said compensation taking the amount from their Security Deposit, it being specified that such authorization to release the Security Deposit to the Host Member shall not constitute a waiver of the Host Member’s right to seek full compensation from the Guest Member for their entire loss.
Members must have an active Membership in order to finalize and participate in an Exchange. If a Member has agreed to an Exchange with another Member that is to take place after the expiry of their Membership, they must renew their Membership in order to take part in the Exchange. If the relevant Member does not renew their Membership within forty-eight (48) hours of HomeExchange contacting them by email to remind them of the need to renew their Membership, the Exchange will be cancelled and the relevant Member those Membership is expired will not be entitled to the protection measures provided for in points 1.3 and 1.4 below.
HomeExchange does not guarantee the legality of any Exchange agreed between Members, nor its proper execution by any Member. Furthermore, HomeExchange does not provide any guarantee regarding the availability of the Accommodation, the conditions of the Accommodation, or any other conditions imposed by one Member on another in the context of an Exchange.
Members alone assume the risks associated with making an Accommodation available or occupying an Accommodation as part of an Exchange including, but not limited to, the risk of damage and theft.
Host Members are free to choose the Guest Member who will use their Accommodation. Host Members and Guest Members must communicate to discuss (and avoid) any issues that may arise from an Exchange.
Host Members must provide and communicate to Guest Members all necessary and useful information about the Accommodation and its features, characteristics and amenities (e.g., swimming pools, lights, and HVAC systems). They must communicate the rules that need to be respected by the Guest Member in its use of the Accommodation.
Host Members shall be responsible for carrying out any formality or notification that may be required by the competent authorities.
Guest Members are solely responsible for the acts or omissions of each of the guests (whether or not disclosed to the Host Member) present in the Accommodation. These guests must comply with all requirements and rules established by the Host Member and must be informed of and comply with these Terms. Guest Members represent and warrant that they are legally authorized to act on behalf of any minors taking part in an Exchange. No minor may participate in an Exchange unless accompanied by an adult who is legally responsible for them.

1.2. GuestPoints

Exchanges are made using GuestPoints that have been acquired in advance.
Upon creating an Account and completing their Listing, a Registered User will receive GuestPoints as a welcome gift. These welcome GuestPoints are valid for a limited period and must be used within three (3) months following the publication of the Listing by the Registered User.
Members may subsequently earn GuestPoints by exchanging their Accommodation or by referring new Members.
The number of GuestPoints earned per Exchange varies depending on our discretionary assessment of the value of the Accommodation based on the number and type of beds, comfort, and location of the Accommodation. The methods used to calculate the value of the Accommodation are described in more detail in our article: “How is the GuestPoints value of my home calculated?”
Members or Registered Users may make limited changes to the GuestPoints valuation proposed by HomeExchange, as described in more detail in our article: “Can I change the GuestPoints value of my home?”
A Member may earn GuestPoints if they complete a reciprocal Exchange (i) with another Member whose Accommodation has a lower GuestPoints value than their own Accommodation, or (ii) with another Member who stays in their Accommodation for a longer period than their own stay. Members who enter into a reciprocal Exchange may, if they agree, change the number of GuestPoints earned/used for that Exchange, provided that the GuestPoints per night do not exceed the GuestPoints suggested by the Platform.
For unilateral, non-reciprocal Exchanges, only the Host Member receives GuestPoints. If a Guest Member does not have enough GuestPoints to complete an Exchange for a given Accommodation, the Guest Member may purchase the missing GuestPoints by credit card via the Platform.
GuestPoints cannot be exchanged for cash or other goods and have no intrinsic monetary value. GuestPoints are non-divisible and cannot be combined with the GuestPoints of other participants. Furthermore, GuestPoints are non-transferable and, for avoidance of doubt, cannot to transferred, for example through inheritance, bankruptcy, or divorce. Any attempt to circumvent these rules by any means is prohibited. Further information about GuestPoints is provided in the section: “About GuestPoints”.
GuestPoints can no longer be used once a Membership has expired. Only by renewing your Membership will you be able to use your accumulated GuestPoints to make new Exchanges. Thus, upon expiry of your Membership, the GuestPoints you have earned will remain attached to your Account for as long as your Account is maintained and not closed, and can be used again once you have renewed your Membership.
The management of GuestPoints credits or debits is automated and does not require human intervention.

1.3 Protection for the Host Member in the event of cancellation by the Guest Member

If a Guest Member cancels an Exchange, the Host Member has the choice of whether to return the corresponding GuestPoints to the Guest Member.
If a Guest Member cancels an Exchange due to an emergency and provides the appropriate documentation, HomeExchange may, at its sole discretion, return the corresponding GuestPoints to the Guest Member (while allowing the Host Member to keep the corresponding GuestPoints).

1.4 Protection for the Guest Member in the event of cancellation by the Host Member

If a Host Member cancels an Exchange, HomeExchange will make every effort to offer the Guest Member the opportunity to stay in one or more alternative Accommodations.
The basic amenities of an alternative Accommodation are as follows:
  • For all Accommodations: Sleeping capacity corresponding to the number of guests disclosed in the Exchange; Hot and cold water supply; Electricity supply; Refrigerator; Bathroom; and Cooking unit (oven, stove, or microwave)
  • Where it has been expressly stated: The alternative Accommodation will have a swimming pool; Internet connection; Access for disabled people.
  • Location: The alternative Accommodation must be located within 50 km of the original Accommodation. The alternative Accommodation must be located within 5 km of a coastal beach if the original Accommodation was located within 5 km of a coastal beach.
If HomeExchange is unable to find an alternative Accommodation with basic amenities equivalent to those of the cancelled Exchange and if the Guest Member's membership remains active, HomeExchange will reimburse the Guest Member, upon presentation of the appropriate documents of one of the following, at the Guest Member’s discretion:
  1. Alternative Accommodation Costs: up to a limit of 15 nights at $120 USD/night (or $350 USD/night if the relevant Accommodation was a Collection Accommodation) or a maximum of $1,800 USD per cancelled Exchange (or $5,250 USD if the relevant Accommodation was a Collection Accommodation); or
  2. Travel Expenses: up to a limit of 15 nights at $120 USD/night (or $350 USD/night if the relevant Accommodation was a Collection Accommodation) or a maximum of $1,800 USD per cancelled Exchange (or $5,250 USD if the relevant Accommodation was a Collection Accommodation).
Note: HomeExchange is not required to find alternative Accommodation or reimburse the Guest Member if the Exchange was to take place in an area under a state of emergency, results from a Force Majeure Event, or is justified by inappropriate behavior by the Guest Member.

1.5 Protection of Members in the event of cancellation of an Exchange by HomeExchange

HomeExchange may, from time to time, at its discretion and for any reason, cancel an Exchange. In this case, HomeExchange may, at its sole discretion: (i) refund the GuestPoints; (ii) allow the Host Member to retain all GuestPoints; (iii) offer a replacement Accommodation; and/or (iv) make any other refund or payment.

1.6 Protection of Guest Members in the event of inadequate or incorrect Accommodation

Accommodation is considered inadequate or incorrect when:
  • There is no electricity, running water, or hot water;
  • There is no functioning refrigerator or cooking appliances;
  • There is a significant presence of pests;
  • There is no functioning toilet, bathtub, or shower;
  • A ground floor door/window cannot be closed;
  • The roof is defective;
  • The sleeping capacity is lower than declared.
Criteria for stated amenities (if applicable):
  • Living area heating < 19°C; Air conditioning > 35°C;
  • Swimming is impossible during pool season;
  • No functioning Wi-Fi or lack of transparency regarding accessibility;
  • No functioning elevator if located above the 3rd floor.
If we are unable to find alternative Accommodations, the GuestPoints will be refunded and HomeExchange will reimburse the Guest Member as per the limits in point 1.4.

1.7 Reviews, ratings, and responses

Following an Exchange, the Host Member and Guest Member may leave comments and a star rating. Members have thirty (30) calendar days from the publication to request the publication of a response (maximum 500 characters). HomeExchange does not verify these opinions. Retaliatory or extortionary reviews are strictly prohibited.

2. ELECTRONIC MESSAGING SERVICE

HomeExchange provides a free electronic messaging service. By using it, you acknowledge and agree that HomeExchange has access to all messages. No information communicated between Members on the service is binding on HomeExchange.

3. AUTOMATED VERIFICATION SERVICE

An Exchange can be finalized only by individuals holding a Verified Account. HomeExchange provides an automated verification service of the identity and address. HomeExchange provides no guarantee or assurance regarding verified Members or their Listings.

4. SECURITY DEPOSIT MANAGEMENT

HomeExchange offers a security deposit management service.
  • Amount: $500 USD for Members; $2,500 USD for Collection Members.
  • Authorization: The Security Deposit is pre-authorized on the Guest Member's credit card at the time of payment for the relevant membership.
  • Claims: Host Members must file a claim within ten (10) calendar days of the last day of the stay via the Contact form.
  • Disputes: If parties cannot agree, HomeExchange will hold the amount in escrow for up to one year or until a legal action has been initiated.

5. 24/7 EMAIL AND CHATBOT ASSISTANCE

HomeExchange provides Members and Registered Users with email and Chatbot support 24 hours a day. Further information on customer service availability is provided on our Contact page.

6. HOMEEXCHANGE'S COMMERCIAL INDEMNITY

7. HOMEEXCHANGE COLLECTION

Collection Members enjoy exclusive services (higher GP value, prestigious community, enhanced guarantees).

  • Qualification: Based on design, architecture, and amenities. List status is at HomeExchange's sole discretion.

V. MEMBERSHIP AND PAYMENT TERMS

1. MEMBERSHIP TERM

Subscriptions are valid for twelve (12) months. Automatic renewal is activated by default. To prevent renewal, click “Cancel my Membership” in your Account. Upon expiration, GuestPoints will be blocked until the Member reactivates their Membership.

2. MEMBERSHIP PRICE

Subscriptions allow unlimited Exchanges (within the limit of GuestPoints). View Membership Prices and Collection Prices.

3. TAXES AND FEES

Prices are quoted inclusive of all taxes. HomeExchange Services are considered digital services.

4. MEMBERSHIP PAYMENT

Payments can be made by credit/debit card or PayPal. Payments are non-refundable except within the 14-day cancellation window.

5. MEMBERSHIP REFUND

Members have a 14-day window to cancel their Membership for a full refund, provided no Exchange has been scheduled. Complete the refund request form to proceed.

VI. INSURANCE

Host Members are solely responsible for obtaining and maintaining valid insurance as required by law. Please see our Service Terms.

VII. PLATFORM AND CONTENT FOR LIMITED PURPOSES ONLY; NO SPAM

Information available exclusively to Members is private. Data mining and SPAM are strictly prohibited. HomeExchange reserves the right to delete (without refund) the Account of any Member who uses the Platform for SPAM or commercial solicitations.

VIII. INTELLECTUAL PROPERTY RIGHTS AND COPYRIGHT

1. USER CONTENT

You grant us a non-exclusive, transferable, sub-licensable, royalty-free, irrevocable and worldwide license to use, copy, and promote your User Content. You represent that you have the right to grant this license.

2. PLATFORM CONTENT

HomeExchange owns all intellectual property rights relating to the Platform. You agree not to copy or sell any content appearing on the Platform without written consent.

3. COPYRIGHT POLICY

XI. DISCLAIMER OF WARRANTY

UNLESS OTHERWISE SPECIFIED IN WRITING, THE PLATFORM AND SERVICES ARE PROVIDED “AS IS.” TO THE FULL EXTENT PERMISSIBLE BY LAW, HOMEEXCHANGE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. USE OF THE SITE IS AT YOUR SOLE RISK.

XII. LIABILITY

HOMEEXCHANGE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE PLATFORM OR PARTICIPATION IN AN EXCHANGE. IN NO EVENT SHALL HOMEEXCHANGE'S TOTAL LIABILITY EXCEED THE AMOUNTS PAID FOR MEMBERSHIP (OR $100 USD IF NO PAYMENT WAS MADE).

XIII. INDEMNIFICATION

YOU AGREE TO INDEMNIFY AND HOLD HARMLESS HOMEEXCHANGE FROM ANY LIABILITY, CLAIM, OR DAMAGE RESULTING FROM YOUR ACTION OR OMISSION, MISUSE OF THE PLATFORM, OR VIOLATION OF THESE TERMS.

XIV. DISPUTE RESOLUTION

UK specific: The Arbitration Agreement, Jury Trial Waiver and Class Action Waiver below do not apply to you if you are a UK Consumer.

DISPUTES WITH THIRD PARTIES

You remain solely responsible for agreements with third parties (HOAs, insurance, leases).

ARBITRATION AGREEMENT

You agree to try to resolve disputes amicably for sixty (60) days via the Contact form. If not resolved, disputes will be settled by binding arbitration in New York City using AAA Rules. Claims will be conducted on an individual basis only.

WAIVER OF JURY TRIAL

BY AGREEING TO ARBITRATION, YOU ARE WAIVING ANY RIGHT TO A TRIAL BY JURY. You may opt out of this clause within 30 days by emailing support@homeexchange.com.

NO CLASS ACTIONS

Any dispute resolution will be conducted on an individual basis only. You may opt out within 30 days by emailing support@homeexchange.com.

XV. MISCELLANEOUS

  • APPLICABLE LAW: Governed by the laws of the State of New York, United States.
  • SEVERABILITY: If any part of these Terms is unlawful or invalid, that part shall be deemed not to be part of the Terms; the remainder remains in effect.
  • ASSIGNMENT: HomeExchange may assign its rights without your consent.
  • LANGUAGE: English version prevails in the event of discrepancy.
