Wat is het doel van ons Privacybeleid?

HomeExchange SAS, beheerder van de HomeExchange-website, hecht groot belang aan de bescherming en vertrouwelijkheid van je persoonsgegevens. Wij zien dit als een essentieel onderdeel van onze betrouwbaarheid en het vertrouwen dat leden in ons stellen.

Op wie is ons Privacybeleid van toepassing?

Ons Privacybeleid is op jou van toepassing, ongeacht waar je woont, zolang je ten minste 18 jaar oud bent.

Ben je jonger dan de hierboven genoemde wettelijke leeftijd, dan mag je onze diensten alleen gebruiken met voorafgaande en expliciete toestemming van één van je ouders of van de persoon die het ouderlijk gezag uitoefent. Waarom verwerken wij je persoonsgegevens en op welke rechtsgrond?

Wij verwerken je persoonsgegevens voor de volgende doeleinden:

Om onze dienst en alle bijbehorende functionaliteiten te kunnen aanbieden en gebruiken, op basis van onze Gebruiksvoorwaarden.
Om gebruikersaccounts correct te gebruiken en te beheren (zoals het aanmaken en verwijderen van accounts, toegang tot de dienst, verificatie, risicopreventie, blokkering/blacklisting, enz.), op basis van onze Gebruiksvoorwaarden.
Om marketingactiviteiten uit te voeren richting potentiële gebruikers met een profiel vergelijkbaar met dat van jou (bijvoorbeeld retargeting) en hen gerichte advertenties aan te bieden, op basis van je voorafgaande toestemming of ons gerechtvaardigd belang.
Om gepersonaliseerde kortingen en aanbiedingen te communiceren die aansluiten bij jouw profiel en gebruik van onze dienst, op basis van je voorafgaande toestemming.
Om reacties te plaatsen, op basis van onze Gebruiksvoorwaarden.
Om communicatie tussen gebruikers onderling en met onze supportdienst mogelijk te maken via ons interne berichtensysteem, op basis van onze Gebruiksvoorwaarden.
Om communicatie met onze supportdienst mogelijk te maken via onze chatbot, die beschikbaar wordt gesteld op basis van onze Gebruiksvoorwaarden.
Om opmerkingen te kunnen schrijven met betrekking tot het beheer van je dossiers, op basis van onze Gebruiksvoorwaarden.
Om advertenties te kunnen plaatsen en/of hierop te reageren, op basis van onze Gebruiksvoorwaarden.
Om online betalingen te kunnen uitvoeren, op basis van onze Algemene Verkoopvoorwaarden.
Om je gegevens te anonimiseren en deze in geanonimiseerde vorm te delen met universiteiten voor onderzoeksprojecten. Hierbij worden geen persoonsgegevens gedeeld.
Om je technische e-mails te sturen die noodzakelijk zijn voor het goed functioneren van onze dienst (zoals wachtwoordwijzigingen), op basis van onze Gebruiksvoorwaarden.
Om video’s af te spelen en zo een dienst van hoge kwaliteit te kunnen leveren, op basis van onze Gebruiksvoorwaarden.
Om functionaliteiten voor sociale media te laten werken, op basis van onze Gebruiksvoorwaarden.
Om een gebruikersscore vast te stellen die niet-nalevend of ongepast gedrag weerspiegelt, overeenkomstig onze Gebruiksvoorwaarden en ons gerechtvaardigd belang om misbruik van onze diensten te monitoren.
Om uitwisselingen die via de website plaatsvinden te monitoren, op basis van onze Gebruiksvoorwaarden en onze wettelijke verplichting om fraude te bestrijden.
Om documenten te kunnen downloaden en uploaden op ons platform, op basis van onze Gebruiksvoorwaarden.
Om dagelijks de veiligheid en kwaliteit van onze diensten te waarborgen en te verbeteren (bijvoorbeeld via statistieken en gegevensbeveiliging), op basis van onze wettelijke verplichtingen, onze Gebruiksvoorwaarden en ons gerechtvaardigd belang bij een goed functionerende dienstverlening.

Je persoonsgegevens worden rechtstreeks bij jou verzameld wanneer je gebruikmaakt van de HomeExchange-website. Wij verwerken je gegevens uitsluitend voor de hierboven beschreven doeleinden.

Welke persoonsgegevens verwerken wij en hoe lang bewaren wij deze?

Hieronder hebben wij de categorieën persoonsgegevens en de bijbehorende bewaartermijnen samengevat:

Persoonsidentificatiegegevens (zoals achternaam, voornaam, enz.) worden bewaard gedurende de volledige looptijd van de dienstverlening en daarna gedurende de toepasselijke wettelijke verjaringstermijnen, die in de regel vijf jaar bedragen.
Economische en financiële gegevens (zoals bankrekeningnummer, verificatiecode, enz.) worden bewaard gedurende de periode die noodzakelijk is voor het verwerken van de transactie en het beheren van facturatie en betalingen, en daarna gedurende de toepasselijke wettelijke verjaringstermijnen, die doorgaans 5 tot 10 jaar bedragen.
Contactgegevens (zoals postadres, e-mailadres en telefoonnummer) worden bewaard totdat je account wordt verwijderd, en daarna gedurende de toepasselijke wettelijke verjaringstermijnen, die doorgaans 5 jaar bedragen.
Gegevens over je persoonlijke leven (zoals foto’s van je woning, vakantiebestemmingen, bewijs van adres, enz.) worden bewaard totdat je account wordt verwijderd, en daarna gedurende de toepasselijke wettelijke verjaringstermijnen, die doorgaans 5 jaar bedragen.
Verbindingsgegevens (zoals logbestanden, IP-adres, enz.) worden bewaard gedurende een periode van één jaar.
Het identiteitsbewijs (identiteitskaart of paspoort) dat tijdens de registratie wordt gebruikt, wordt onmiddellijk verwijderd nadat je identiteit is geverifieerd.
Financiële en betaalgegevens (zoals bankrekeninggegevens, IBAN, enz.) worden bewaard totdat je account wordt verwijderd, en daarna gedurende de toepasselijke wettelijke verjaringstermijn van 5 jaar.
Alle informatie die je verstrekt via ons interne berichtensysteem of onze chatbot wordt bewaard gedurende de volledige looptijd van de dienstverlening en daarna gedurende de toepasselijke wettelijke verjaringstermijnen, die doorgaans vijf jaar bedragen.

Zodra de toepasselijke bewaartermijnen zijn verstreken, is het verwijderen van je persoonsgegevens onomkeerbaar en kunnen wij deze gegevens daarna niet meer aan je verstrekken. Hoogstens kunnen wij uitsluitend geanonimiseerde gegevens bewaren voor statistische doeleinden.
Hou er rekening mee dat wij in geval van een juridisch geschil verplicht zijn alle gegevens die op jou betrekking hebben te bewaren gedurende de volledige looptijd van de procedure, ook nadat de hierboven beschreven bewaartermijnen zijn verstreken.

Welke rechten heb je om het gebruik van je persoonsgegevens te controleren?

De toepasselijke wetgeving inzake gegevensbescherming kent je specifieke rechten toe, die je op elk moment en kosteloos kunt uitoefenen om te bepalen hoe wij je persoonsgegevens gebruiken.

Recht op inzage en het verkrijgen van een kopie van je persoonsgegevens, voor zover dit verzoek niet in strijd is met bedrijfsgeheimen, vertrouwelijkheid of het correspondentiegeheim.
Recht op rectificatie van persoonsgegevens die onjuist, verouderd of onvolledig zijn.
Recht op verwijdering (“recht om vergeten te worden”) van je persoonsgegevens die niet noodzakelijk zijn voor het goed functioneren van onze diensten.
Recht op beperking van de verwerking van je persoonsgegevens, waardoor het gebruik van je gegevens tijdelijk wordt beperkt in geval van een geschil over de rechtmatigheid van de verwerking.
Recht op overdraagbaarheid van gegevens, waarmee je bepaalde persoonsgegevens kunt ontvangen om deze op te slaan of eenvoudig over te dragen van het ene informatiesysteem naar het andere.
Recht om instructies te geven over wat er met je gegevens gebeurt in geval van overlijden, hetzij door jouzelf, hetzij via een vertrouwenspersoon of een begunstigde.

Om een verzoek in behandeling te kunnen nemen, moet dit rechtstreeks door jou worden ingediend via dpo@homeexchange.com. Verzoeken die niet op deze manier worden gedaan, kunnen niet worden verwerkt.

Verzoeken kunnen uitsluitend door jou zelf worden ingediend. Wij kunnen je daarom vragen om een identiteitsbewijs te verstrekken als er twijfel bestaat over de identiteit van de verzoeker.

Wij reageren zo snel mogelijk op je verzoek. In geval van een technisch complex verzoek of wanneer wij meerdere verzoeken tegelijk ontvangen, kan de reactietermijn oplopen tot maximaal drie maanden na ontvangst van het verzoek.

Hou er rekening mee dat wij buitensporige of ongegronde verzoeken kunnen weigeren te behandelen, met name wanneer deze herhaaldelijk worden ingediend.

Wie heeft toegang tot je persoonsgegevens?

Je persoonsgegevens worden verwerkt door onze teams en door onze technische dienstverleners, uitsluitend met het oog op het aanbieden en laten functioneren van onze dienst. In specifieke gevallen kunnen wij gegevens ook doorgeven aan onderzoeksinstellingen of universiteiten voor onderzoeksdoeleinden.

Wij benadrukken dat wij al onze technische dienstverleners zorgvuldig selecteren en controleren voordat wij met hen samenwerken, om te waarborgen dat zij strikt voldoen aan de toepasselijke regels voor de bescherming van persoonsgegevens.

Kunnen je persoonsgegevens buiten de Europese Unie worden doorgegeven?

De persoonsgegevens die via onze HomeExchange-website worden verwerkt, worden uitsluitend gehost op servers die zich binnen de Europese Unie bevinden.
Daarnaast doen wij er alles aan om uitsluitend gebruik te maken van technische tools waarvan de servers eveneens binnen de Europese Unie zijn gevestigd. Wanneer dit niet het geval is, zorgen wij ervoor dat passende waarborgen worden toegepast die vereist zijn om de vertrouwelijkheid en bescherming van je persoonsgegevens te garanderen.

Hoe beschermen wij je persoonsgegevens?

Wij treffen dagelijks passende technische en organisatorische maatregelen om de beveiliging van je persoonsgegevens te waarborgen en om elk risico op vernietiging, verlies, wijziging of ongeoorloofde openbaarmaking tegen te gaan.

Technische beveiligingsmaatregelen
A/B-testen, gescheiden opslag van gebruikerswachtwoorden en gebruikersnamen (back-end), versleuteling van de gebruikersdatabase, zowel opgeslagen (at rest) als tijdens overdracht (in transit), versleuteling van gebruikerswachtwoorden (front-end), verplichte complexe wachtwoorden voor gebruikers bij het inloggen (front-end), gebruik van het HTTPS-protocol, intrusietests, traceerbaarheid van toegangsactiviteiten, gebruik van VPN voor teams van HomeExchange SAS, MFA-bescherming (meervoudige authenticatie) aan de server- en databasezijde, beveiliging van accounts, gecentraliseerd toegangsbeheer, realtime monitoring van verdachte activiteiten, scheiding van productie- en testomgevingen en versleuteling van back-ups.

Organisatorische beveiligingsmaatregelen
Informatiebeveiligingsbeleid voor informatiesystemen, procedure voor het beheer van datalekken, procedure voor het beheer van persoonsgegevensrechten, gedragsregels, bewustwording en training van teams tweemaal per jaar, cameratoezicht op de bedrijfslocaties, brandveiligheidstraining en EHBO-training.

This policy (“Privacy Policy”) describes how HomeExchange Inc. with an address at C/O WEWORK, 625 Massachusetts Avenue, Cambridge, MA 02139 (“HomeExchange” or “we”), collects and uses personal information from users across various platforms, including www.homeexchange.com, the HomeExchange application, other websites, mobile sites, services, applications, and platforms operated by HomeExchange where this Privacy Policy is featured or referenced, or where no separate Privacy Policy is provided, as well as from customers who interact with us through other channels (collectively, the “Sites”). The words “user,” “you” and “your” in this Privacy Policy refer to a user of the Sites.

Please read this Privacy Policy carefully, as it applies each time a user accesses the Sites and uses their services.

By using the Sites, you represent that you have read, understood and agree to be bound by this Privacy Policy, the Privacy Policy for California Residents, if applicable to you, the Privacy Policy for Texas Residents, if applicable to you, the Privacy Policy for Nebraska Residents, if applicable to you, the Sites’ Terms of Use, and Cookie Policy (collectively, the “Website Policies”). The categories of personal information we may collect from you include:

Account Information. We collect personal information that you provide when you register for an account to use our services and/or purchase a membership or GuestPoints, which may include your name, year of birth, email, home address, proof of address, account preferences, such as preferred language, and any other information necessary to set up and verify your account such as driver’s license number, state identification card number, or passport number;
Inquiries. We collect personal information that you provide when you contact us and inquire about our services, such as your name, email, phone number, and any other information you provide;
Use of Services and Purchases. We collect personal information that you provide when you use the services that we offer and/or purchase a membership or GuestPoints through the Sites, such as your name, email, home address, billing address, phone number and any other information you provide. We may also collect details about the transaction, such as purchased membership or GuestPoints details, purchase price, and the date of the transaction. Further, when you make a purchase with us directly online or decide to store your payment information with us, we also need to collect credit card or other payment information. Please note that we do not collect and maintain your payment information directly, instead we utilize a third-party payment processor to collect and facilitate all online payments on our behalf. Additionally, if you choose to store your payment information on your account, such information will be stored by the payment processor and not with us directly. Please see the section on how we share information with our payment processor below for more information;
Promotions. If you enter a contest, sweepstakes, or other promotion, we collect information about you, such as your name, username, date of birth, home address, email address, phone number, and ZIP code and any other information that needs to be provided to participate in the promotion, as described by the relevant terms in each instance;
Marketing Communications. If you sign up, we collect your name, email, phone number and applicable interests and communication preferences in order to send you regular updates about the products and services we provide.
Promotional Events. If you register for an event, we collect information about you, such as your name, email address, phone number, and any other information that needs to be provided to participate in the event, as described in the relevant terms in each instance. Depending on the event, if we take photos and/or videos of the event, photos and/or videos of the participants may also be collected.
Reviews. We collect personal information that you provide when you submit a review on the Sites, this may include your name, email address, any photos you submit, and metadata associated with your review content, such as details about how, when, and by whom the content was created, as well as its formatting;
Surveys. We collect personal information that you provide when you submit an entry to one of our surveys, this may include your name, email address, as well as travel habits, and any other information you provide;
Communication with Other Sites’ Users. We collect personal information that you provide when you message with other Sites’ users through the Sites, this may include your name, email address, as well as the content of the communications.

Please be aware that if you do not allow us to collect certain personal information from you, we may not be able to deliver certain services to you, and some of our services may not be able to take account of your interests and preferences. If collection of personal information is mandatory, we will make that clear at the point of collection so that you can make an informed decision whether to provide your information.

B. Automatically Collected Information

When you access or use our Sites, some information not associated with specific users, such as device type, location information, IP address, cookie identifiers, webpage traffic, and access time is automatically collected in order to ensure the Sites’ functionality. Once your user profile is created, anytime you log in, we will collect additional information and add it to your user profile, such as the membership or GuestPoints you have purchased, and any other information that may be available from time to time.

Cookies. The Sites use cookies. A cookie is a small text file that is stored on a user’s computer for record keeping purposes. Cookies can be either session cookies or persistent cookies. A session cookie expires when you close your browser and is used to make it easier for you to navigate our Sites. A persistent cookie remains on your hard drive for an extended period of time.

We use cookies to identify you when you access the Sites, to personalize your experience on the Sites, to provide ads, marketing communications and social media features, to analyze our traffic and customers’ interactions with advertising banners, and to identify repeat visitors for statistical purposes. We also share information about your use of the Sites with our social media, and advertising partners, who may combine it with other information that you have provided to them or that they have collected from your use of their services.

When you first visit our Sites, we provide you with a choice to either accept or deny certain cookies. If you choose to decline optional cookies, please note that some of the features and services of the Sites may not function as well as intended. Even if you choose to accept cookies, you are always free to change your mind and revoke that consent. Most browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies. Please note that the Sites use certain cookies that are fundamentally necessary for the Sites to work and allow you to use the functions of our services. Without this type of cookies, you cannot receive the requested services. C. Third-Party Sources

We may receive personal or aggregate information about you from our business partners and service providers (such as advertising partners, data analytics providers, and mailing lists providers), or other third parties to whom you have provided your information, and consented to the sale, rental or transfer thereof, and combine this information with other information we collect from you. Occasionally, we may obtain information about you from third parties such as a data aggregator or vendor who provide us with additional aggregate information about our existing customers.

Social Media. When creating an account through third-party social media sites and/or applications, we may access some of your information from your social media account, such as name, email address, and profile picture.

Please note that this Privacy Policy does not apply to third-party social media sites, and you should always refer to the privacy policies of the relevant social media sites for information concerning their collection and processing of information.

D. Communications with HomeExchange

Customer Service. If you fill out a questionnaire or contact our Customer Service department by phone or by email, we will collect certain personal information from you, such as your name, address, email address and phone number. We may need to use your personal information to further contact you to respond to your inquiry or request.

Live Chat. If you use the live chat feature on our Sites, we will collect certain information from you such as your name, email address, and information about why you are chatting with us. We only collect this information in order to communicate with you, address why you are chatting with us, and ensure that you have a great customer experience. Some of that information that you provide to us may be considered sensitive personal information as it may reveal your gender, race, national origin, etc. Our live chat is operated by a third-party service provider, who can use such information only in compliance with this Privacy Policy to provide customer service and for no other purpose.
Texts. If you have signed up to receive text messages from us, we may collect information from you through one of our inbound text messaging programs. You agree to receive recurring automated promotional and personalized marketing text (e.g., SMS and MMS) and other messages (e.g., cart reminders) from HomeExchange to the mobile telephone number you provided when signing up or any other number that you designate. Consent to receive automated marketing text messages is not a condition of any purchase. Message and data rates may apply. Message frequency will vary. Our text messaging program is operated by a third-party service provider, who can use such information only in compliance with this Privacy Policy and for no other purpose.

II. How We Use Your Information

Your information is processed using primarily electronic means and is used, without limitation, for the following purposes:

Order Fulfillment. We use information collected to process your order(s), to inform you about the status of your order(s) and to follow up with you about your satisfaction with the purchased membership or GuestPoints;
Service Offerings. We use information collected to provide our services and to follow up with you about your satisfaction with the same;
Account Activity. We may use information collected to maintain your account with us (e.g., account verification), including administering any programs associated with such accounts, to communicate with you regarding your account and for customer support purposes;
Customization. We may use information collected to monitor and analyze trends, usage, and activities in connection with our products and services in order to manage and optimize your browsing experience. Further, we may use the information collected to provide you with product recommendations, offers, content and rewards that are tailored to your interests and profile, and to target advertisements to you on third-party platforms and websites. We may use also information collected to personalize your experience and save you time when you visit our Sites (e.g., by remembering your login ID and password);
Marketing. If you sign up, we may use this information to send you marketing communications, such as email communications, mobile messages (including text and/or push notifications), and postal mailings. These communications may inform you about new products, special discounts and other news and special offers. On occasion, these communications may also contain information or offers about third-party products;
Services and Site Development. We may use personal information to create non-identifiable information that we may use, alone or in the aggregate with information obtained from other sources, in order to help us optimally deliver our existing products and services, develop new products and services, or conduct statistical analyses to the functioning of the Sites. From time to time, HomeExchange may perform research (online and offline) via surveys (directly or through third parties) to help us better serve our customers by learning more about their travel habits, needs and the quality of the services we provide. Anonymized and aggregated information is used for a variety of functions, including the measurement of Sites visitors’ interest in and use of various portions or features of the Sites;
Events, Contests, and Promotions. We may use information collected to host events, facilitate contests, sweepstakes, giveaways, competitions, or other similar marketing campaign or promotion. To comply with sweepstakes laws, we may publish or share limited information about promotion winners (such as name and city of residence). For more information about our contests and other promotions, please see the official rules or details that will be posted with each promotion;
Customer Service. If you have requested further information, contacted customer service or in any other way requested that we contact you, we will use your personal information to respond to such a request. We may also use your information to ensure we are providing the highest level of customer service, and to identify any potential gaps or potential improvements to the same. Further, we may use information collected to send you security alerts, support messages, and other transactional messages;
General Business Purposes. We may use information collected for other general business purposes, such as to maintain the day-to-day operation and security of our Sites, to ensure that our Sites is working as intended, to protect the integrity of our business, and for analytics, auditing and technical assistance purposes. Further, we might use the information collected to secure online transactions, prevent fraud and payment incidents, and manage debt collection;
Corporate Purposes. We may use information collected to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of HomeExchange assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by HomeExchange about our Sites’ users is among the assets transferred; and
Legal Purposes. VIII. Changing, Updating, or Removing Your Information

X. Do Not Track Settings
