Article 1 : Contest Organization
The company: HOMEEXCHANGE.COM INC, a California company registered under number 2403557, headquartered at 45 Prospect Street, Cambridge, MA 02139.
Hereinafter referred to as HOMEEXCHANGE,
Have organized a contest called “HomeExchange invites you to the amusement park of your choice!"
Hereinafter referred to as "the Contest".
Article 2 : The Contest’s Objective
This is a purchase obligation contest and is described as follows: Participants will sign up for HOMEEXCHANGE’s yearly Optimal Membership for the first time for a chance to win four tickets to the amusement park of their choice.
Participation in the Contest implies the participants’ unreserved acceptance of these rules in their entirety,
Hereinafter referred to as "the Regulations".
Article 3 : Date and Duration
The Contest will run from 04/08/19, 8:00 AM, UTC + 2: 00 to 11/08/19, 11:59PM, UTC + 2: 00. The organizer reserves the right to extend the participation period and to postpone any announced date.
Article 4: Conditions for and Validity of Participation
4-1 Conditions for Participation
The Contest is open to all adults who are registered on the HomeExchange website.
All HomeExchange members who have signed up for a HomeExchange Optimal Membership in the past and all persons who have collaborated in the organization of the Contest, as well as members of their respective families, HomeExchange employees, the organizer, or subcontractors of the organizer and its affiliates, etc. are not eligible to participate in the Contest.
4-2 Validity of Participation
Any participation in the Contest will be considered invalid if:
- Participant did not sign up for an Optimal Membership
The organizer reserves the right to withdraw the participation of any person who does not respect the rules and regulations.
Article 5 : Selection of the Winners
The winners will be chosen at random by way of a draw that will take place on August 12, 2019. The winner will be contacted by email within 10 days.
Article 6 : Prizes
The prize, distributed to the winner, corresponds to four tickets to an amusement park of the winner’s choice, for a maximum value of four hundred (400) euros.
Article 7 : Informing the Winners
The winner will be notified via email.
Article 8 : Delivery or Withdrawal of Prizes
Prizes are personal and non-transferable. In addition, the Prizes may in no case be the subject of any dispute on the part of the winners, nor an exchange or any other consideration of any nature whatsoever.
Article 9 : Promotional Operations
By accepting their Prize, the winners authorize HomeExchange to use their name for promotional purposes on any medium of their choice, without this reproduction being entitled to any compensation other than the prize won.
Article 10 : Personal Data
The personal data collected from participation in the contest are recorded and used by the organizer for the necessities of their participation and the attribution of their winnings.
In accordance with the "Data Protection Act" of 6 January 1978, Participants have the right to access, rectify or delete information that concerns them. All requests must be sent by email to the organizer’s email address: contact@homeexchange.com.
Article 11 : Liability
The Participant acknowledges and agrees that the only obligation of the Contest Organizer for the Contest is to submit the entries collected to the draw, provided that this is done in accordance with the terms and conditions of the Contest Rules, and to provide the winner with the prize according to the criteria and modalities defined in this Regulation.
The organizer cannot be held responsible, without this list being limited to any technical, material, or software failure of any nature whatsoever, the risk of contamination by any viruses circulating on the network and the lack of protection of some data against possible diversions. Participation in the Contest implies knowledge and acceptance of the features and limitations of the Internet in terms of technical performance, response time, as well as to query or transfer information.
Article 12 : Cases of Force Majeure / Reservations
The organizer's liability cannot be incurred if, due to a case of force majeure or anything beyond the organizer’s control, the contest must be modified, shortened, or canceled. The organizer reserves the right to carry out any verification it deems useful, relating to compliance with the rules, in particular to rule out any participant who has made an inaccurate, false, or fraudulent declaration.
Article 13 : Disputes
The Regulation is governed by French law. Any difficulty in applying or interpreting the Rules will be decided exclusively by the organizer. No request or telephone complaint will be answered regarding the application or interpretation of this Regulation. Any dispute or claim relating to the Contest and the draw must be made in writing to the following address: contact@homeexchange.com
No dispute will be taken into account starting eight days after the close of the Contest.
